    At this stage you don't need to send any proof (and cannot).

    If the case ends up in court you will then have the opportunity to furnish the defendant and the court with any evidence you want to use.

I'm filling a claim form atm and I have just realised I have no proof of how much cashback they promised me! that bit of info wasn't in all the paperwork I was sent and my online stuff is kinda deaded after a massive hard drive crash (my next post may be a comlplaint about maxtor), will proof of my first installment coupled with proof that they have missed the 2 after that stand up in court? did anyone else get a 12 month contract on a clearence N80 about 18 months ago that could vouch for the offer?
  • Be aware - Mobile Rainbow or directphoneshop.co.uk or Msols or Bunny Connect (all the same company!!) are not paying / delaying on cashbacks. Customer service emailing standard replies - when you get a response that is.

    Note - the directors also run the following mainly internet based retail companies, so you can possibly expect the same level of customer service & performance / integrity:

    MSOLS ltd ta Mobilerainbow will be entering administration soon. They have run out of money and are no longer paying cashbacks. If you have any outstanding unpaid claims, you should use MCOL as soon as possible.

    Guys, anybody heard the latest with this company, heard rumours they have gone to the wall, and also cannot get through on phones etc I can't believe there's 24 pages on this thread

    Also need some advise, I didn't send original invoices into these shysters ( i downloaded them off the 3 website) for my first 6 months claim and got the following response "13.9 Claims received with scanned copies of bills, computer generated bills, and duplicate bills issued by the network will be rejected. Additional claims received through emails will also be rejected."

    Despiute me emailing them 20 times since then and trying to call them numberous times, I have been fobbed off with the same, despite me quoting til I'm blue in the face the Ofcom Code of Conduct , is it even worth me starting with the claim?

    Any advice would be appreciated!!

    If you knew what you were doing you would have followed the t&c and not relied on any "guidelines" which are plainly worthless. No matter how many emails you sent they appear to have simply quoted the t&c which you seem to have ignored. Now you have to ask what basis you have for suing (the only one would be if these were NOT the t&c you signed up to) AND whether the company would be around long enough to cough up IF you win. Seems to me you're on a hiding to nothing, having chosen the worst company and then ignored the t&c.

    Hello I have just been photocopying all my evidence to send to court, it needs to get there 14 days before the hearing, and then I have to take originals to court on the day. I have been told that although my case should be at 10.30, it may be delayed, and I have to make myself available all day. Even more costs to claim from Mobile Rainbow then!
    They owe me for the whole year, and my first claim was sent to them last August for the first 6 months of my contract so a payment of £157.50 was due on 30th September '07.
    A couple of weeks ago (180 days late!) they sent a payment of £91.88 to my bank which does not even reach the amount for the first 6 months and asked me to inform the court that they had paid in full. Ha ha they are mad. They had divided the total cash back of £367.50 by 4 and tried to say that was it! Their defence to the court is silly, they say that they had technical problems.
    I hope they show up at the court case I would love to hear them trying to defend themselves. I'll let you know, and good luck to all who claim. As I have said in a previous post however, winning the case does not necessarily mean getting the money ... that's another problem, but winning will be sweet!
    Anyone got any results to share?

    K271:- I strongly recommend you check the facts and your t&c before arguing THAT in court. Whilst you may be able to claim for the whole year cashback schemes do NOT work in the way you seem to think - i.e. payments corresponding to the proportion of the contract consumed to a given date! If you have that wrong it might harm your presentation (which may well otherwise be quite sound!).

    How much does it cost to go to court?? It now seems people are going to have to go all the way with this company now and attend court to get their money bach, has anyone on here yet actually attended court against them yet??
