    Looking back on your post, with it being a credit card ppi, I don't think it will matter then if you cancel now or later.


    So you think I have a case even though I don't even remember whether I had a conversation, ticked a box etc?

    Hi

    With the fact that you stated you already had protection in place, and if this was discussed when it was sold to you, then you would have had the opportunity to have expressed this.

    If it was sold over the telephone, it may be worth you asking for the copy of the conversation, but another way if you are unsure is to request a SAR - for all your data in regards of the account, which may help you remember when you receive these details.

    MrsBris - An Subject access request (SAR) is optional and costs the one off payment of £10 cheque or postal order, they have 40 calendar days to comply to this and send all data they hold going back to the last 6 years, some will go beyond that.
    There is a fulll sar template letter below you can use if you want to, if you feel you require more paperwork before you make a reclaim.;)

    Thank you! Unfortunately my memory isn't that clear so a SAR may be a good idea to add strength to my case!

    You are very welcome.;)

    And of course, we are all given agreements to sign, but there are many reasons for having been mis sold, more details below as well if you want to check them through.

    So despite signing the agreement, sometimes the PPI have automatically been included/ticked for by the bank/finance company, where some assume then it was all part of the package.

    I've made a claim against HFC for mis sold ppi which they've said they'll uphold and I'm just waiting for them to tell me how much money they've robbed me of... Sorry I mean how much redress I'm due!

    What I wanted to ask the forums opinion on though is actually making a claim against Natwest for credit card ppi (and bank charges but I think that's another thread). The cc was "sold" to me in around 2000 when I applied for a current account. The cc was more or less sold as a feature of the current account. There is an outstanding balance of around £4k on the cc although it hasn't been in use for about 4 years and I haven't made regular payments since then.

    Now for the amusing bit, I wasn't told at the time that I could get ppi anywhere and nor did they ask what benefits etc my employer offered that may help to cover me if I was sick etc., they didn't need to as I was working for Natwest at the time (I was in support services before I shed load of pitch forks come my way!). I wasn't even told that it was optional, just that it was something you got with the cc and was a good way of protecting me (was it f@!?). When I was unemployed for 6 months and was struggling to keep up with payments turned out it was no good anyway!

    I believe I have a valid claim for the misselling of ppi in this case and know the cc number it relates to but can't be sure as to how much I paid in ppi as I don't have all my statements. *finally she gets to a question* should I go straight to claiming for the ppi as I have the account number and know the circumstances of how it was sold to me or should I put in a SARS before starting a claim so I can at least I work out how much ppi I've paid?

    Personally, I'd go for the SAR

    You say you havent made payments but theres a balance of 3k?

    How long ago did you stop making payments?

    You have to bear in mind they are entitled to take any arrears owed out of the PPI claim, so with a 3k balance if you havent paid for several years its very likely they'll take the entire PPI refund to settle the card

    So, did you actually make a formal claim against the PPI, but get turned down? (this would, as you say, be a clear case for misselling)

    Also, have they defaulted you for the lack of payments?

    If so, whether you pay or not in the future that defaault will remain on your credit file for 6 years so its worth considering whether you should contact them or just "let it lie" as if you go for the PPI that then recognises the debt and re starts the 6 year limitation period should they decide to go legal over the 3k debt (as it stands, if you have paid nothing and not admitted the debt in writing for 6 years, they cannot enforce it at law due to the statute of limitations act)


    Might be worth starting a seperate thread under the main "Reclaim PPI and other insurance board"

    Go HERE and click "new thread" then enter a title such as "Nat West card and PPI - Complicated!"

    (sorry if you already know this - just covering all bases!)


    If you could put as much detail as poss under there (without revealing personal details of course) we can all try and help?

    Such as:

    Date card started
    Rate of interest
    Amounts and dates of any PPI premiums added
    Date last payment made
    Default registered by bank?
    Is a Debt Collection Agency involved?

    Well if that is correct and £30 was paid every month for 156 months at an APR of 29%, the claim could be as much as £54,000 :rotfl:

    As you say, they wouldn't pay it, nor was the ppi £30 every single month.

    I've just declared war on MBNA.

    Got an email from one of their customer services people last Friday to say complaint upheld and a formal response would be issued by today, as the claim was in the final calculation stage.

    Nothing in today's post so rang up their Customer Advocate Office. Told them about the email I'd received. The lady checked on the system and said I don't know why you were sent that because your claim is still being investigated and has not been passed for calculation, and it is going to be another 3 weeks or so before the investigation is completed. She then said that the email I got wasn't recorded on my case file.

    So it appears that their staff are blatantly lying to people to get rid of you when you contact them. I've copied the email to their CEO demanding an explanation of why he thinks it is acceptable for his staff to deliberately lie to customers and why I should not report this to the FOS. It'll be interesting to see what their response is (if they respond at all that is).
    Its amazing how these banks can't even do simple calculations correctly..............
