Just to let you know I got word back from GM Card(letter dated 29/11/2010) saying basically that my complaint / claim for PPI mis selling is on hold pending the outcome of the BBA action.
As they are owned by HSBC I am now also awaiting the same letter from them re a claim for mis sold PPI on a loan that is going through at the moment.
Both complaints were made 28th September 2010.
Will just have to sit tight & wait and see for now I guess.

I assumed you should be able to continue your complaint through the FOS if this is the case......maybe you should contact the fos to make sure on this.

Hi there, you can cancel your complaint at any time, although they do normally sort this out if your successful, if you want to see what the outcome of this is first its up to you, but you do have the right to cancel anytime you want.

Yes - They do say that if I wish to take my complaint further that I can do via the courts or FOS.
They do not mention final decision though.0 -

I have some questions before I start a PPI reclaim; I have had a bank account with NatWest for around 18 years, and as far back as I can remember I have had a credit card with this account. However, I have only just noticed this PPI fee on my statement, although I'm convinced they have been charging me this for a very long time (I simply trusted that the bank wouldn't rip me off and that it was basic charges, so never questioned it). I've now noticed that some months they have charged me as much as £90 per month on PPI! with bank charges totalling over £300!!!
Q1 - I cant remember how or when the PPI started, will this go against my claim?
Q2 - should I stop the PPI payments immediately with the bank? or should I start the PPI claim before I cancel the PPI?
Q3 - As a result of this I am moving my bank to a new bank with '0' bank charges for 12 months, is it wiser to do this once the claim has been settled?

Hi and welcome
That is a very long time.
It will not go against your claim.
Your able to cancel at anytime, normally in writing, some wait until its resolved but that is up to you.
The bank should treat your fairly, when your making a reclaim as you have the right to make a reclaim on what is rightfully yours, they have a lenders code to follow on how to treat customers fairly.
If you feel better by moving on to a new account that is fine, your able to do this too if you want to.;)
You could optionally request for a Subject access request (SAR), they have 40 calendar days to comply and send all they hold on the account going back at least the last 6 years, some go back even longer.

To make a reclaim on the ppi, there is a questionnaire on the link below, send to whoever set up your policy from the start, and remember to keep copies of all you send and receive in case you need to refer to this at some point.
They do normally have 8 weeks to give a decision.

If this is not final, then I would write back again, basically until you do receive a final decision, good luck. The final letter they should confirm this and enclose the actual leaflet details of the FOS.

They say that they are carrying on handling complaints as normal as the lenders do not have permission to put complaints on hold.
Not sure which is the best way to jump.

Your welcome.
You have a think of what you think is best for you now, maybe you could write another letter to them and give them say 14 days to get back with the final decision, and if they don't change this or you don't hear anything by then - complain to the FOS.
