Hi Di and thank you for your reply.

It does say that if we disagree with how he has reached his conclusions to reply by 11 November telling him the reasons and any evidence we may have that has not already been provided. It says we will then also have the right to ask the ombudsman to review the case as the final stage in the process.

The loans were taken out in 2003 (so 7 years ago).

We didn't request the SAR from the company, as it all seemed a bit pointless. DH remembered signing the form that stated 'optional PPI', but there's obviously nothing on that form that tells you that they'd told you verbally that you wouldn't get the loan without accepting PPI.

For both loans it is stated in the Adjudicator's letter that 'Nationwide have been unable to provide a copy of the sales recording due to the amount of time that has elapsed since the sale'. Funny that ... (and heaven knows what the 400-page document was that the Adjudicator said he had to read?!)

    :(

    Hiya
How long ago did you finish the loan?

If in the last recent years, they should still hold these details, but its up to you of course if you want to request for a SAR.

Will the FOS forward you on a copy of that 400 page document?

    Xx

It was around September 2006 that it was paid off.

NW's response before he went to the FOS was that he has signed the paperwork that says 'optional'. In the official complaint form to the FOS he wrote:

With regards to Nationwide’s reply of 10 December (copy enclosed), I would simply state that I recall signing various documentation, but I was not at all happy about the LoanCare cover. However, I had been told on the telephone that I had no option but to take it, as I would not get the loan without it. At no point was I told this was optional, despite what any paperwork may say. I was told to take it with the cover or not have the loan at all.

For that reason, I'm not sure what good an SAR would be?

It's not sounding very positive. We're just so disappointed. :(

Yes i know what you mean.

But i would defo move this on for a review, maybe the ombudsman will look at this differently to that of the adjudicator, make your point to them how upsetting this have been.
It have still been known for them to overturn a rejected decision, and if they do, you will probably be awarded further distress redress on top as well for the inconvenience. X:)

  • Hi there

This my first time using this forum so bear with me.

I took out a loan with Llloyds Bank back in June 2003 for £10,000. I was asked if I wanted PPI on the loan, at the time I thought it was a good idea as I have a cronic back condition.

I was making all payments on time. After a couple years I was made redundant, I informed the bank and the PPI was put into place. After 12 months the payments stopped and the loan was referred to their recoveries dept. I was under the impression PPI covered me for the duration of the loan. Not so.

Having taken advice from my local CAB, I set up a payment plan with a collection agency. Things were okay until I discovered they were taking out more than we had agreed. I stupidly canceled the direct debit. Things got worse from then on, I put my head in the sand and tried to forget about it until they started court proceeding against me. I have set up another payment plan with them to stop this.

I have also written to the bank asking for all information with regards to the loan I took out with them. I recieved a letter back form them, this is where i'm confused.

The loan was for £10,000, but the statment shows it was for £7,800 and £2,200 loan for PPI plus another £2,150 for some reason.

It also shows after each payment was paid I was charged interest on that payment of at least £100.

Sorry to go on so much.

Can anyone shed some light on what I should do.

    Thanks in advance

    Hi and welcome

Hopefully someone will post up in regards of the calculations on the loan/ppi etc who will know more of how this works, with my loans with Lloyds its shown the amount of the loan, the amount of PPI, then they total them together as one owed payment and of course interest is also added on top.

    A suggestion.
There is a thread above called debtfreewannabe thread, where many have been in the same situation as yourself, when gone into arrears and so on, you can ask for template letters to stop any harassment from creditors and other letters that may also be of some use for you if needs to be.

    The thread stated is here:
    http://forums.moneysavingexpert.com/forumdisplay.php?f=76

If this was sold in the branch, then normally the ppi would have been discussed, but I am aware this is not always the case, and of course if you had a pre-med condition when you taken it out and required to make a claim on this actual condition later on, they would not pay out for this one.

It seems it was not discussed with you as they did not explain the terms of the loan etc.

And of course its likely your still paying this ppi off with the loan too, which adds to the debt, and now your not able to use it, due to your circumstances - which includes a payment plan, its now worthless to you.

You could try making a reclaim on the ppi payments you made into the account plus interest, and if you succeed, it will normally be used to help reduce the debt, and anything remaining plus interest should be awarded directly to you.

For more on reclaiming, check below, if you go for this then complete the reclaiming questionnaire here:
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance#reclaim
The questionnaire replaced the template letter, send to Lloyds address below.....
Remember to keep copies of all you send and receive, this is in case you need to refer to this at some point, or make a complaint to the financial ombudsman service (FOS).

    Lloyds PPI
    Customer Care
    Lloyds TSB Insurance
    Tredegar Park
    Newport
    South Wales
    NP10 8SB

Please be aware at this current time, ppi complaints have been frozen for the time being on new reclaims, due to the Judicial Review, will post the link to more of this below, but if you hear nothing by 8 weeks, then continue to make the complaint to the FOS.

Wishing you luck, please keep us posted, and do check the debtfreewannabe thread too, you will also get the help you need to get you through this.
    Good luck.;)
