Hi recently received the paperwork back from HSBC after sending them a SAR. We specifically wanted ppi details on the credit card and a completed loan that we had with them. They have sent a large bundle relating to the credit card I cant see any data on the insurance or any ppi?? their letter states that the "credit card agreement cannot be located in their records as it is not held in structured filing system i.e. in files referenced with our name or account details and is therefore outside the scope of the Data protection Act 1998." The statements show no insurance detail at all ( now im not sure if there was any on the card or not ) Plus they have not sent any data on the loan do I have to send another £10 to get the data held on that agreement ?0

Hi again I have been claiming ppi from tesco plc for the last year in july the ajudicator rang me to ask more question and told us she had upheld our case. did,nt hear anything till sept 14 when I got a letter from fos with an acceptance form sent this off. I was a bit worried when the banks stopped dealing with complaints so I rang tesco we see what there stance was they would,nt say anything sppart from they had not had an acceptance form back from fos. I rang this fos they said they were sending it that was 4 weeks ago rang tescos they have still not recieved the acceptance form from fos. I rang fos but the person dealing with my case is always in meetings. not sure whats going on if they are going to pay out or not bit disappointed in the fos.Tesco not saying either way you would have thought once fos had upheld and offer made then its binding. will trying ringing fos again tomorrow:A0

Hi everybody
I really could do with your advice.
My DH put a claim in to the FOS in December 2008. He has been chasing it fairly regularly recently and finally we got an Adjudicator to start taking a look at the case. DH spoke to him last week and he said that Nationwide had sent a huge 400-page document for him to wade through, but that things looked quite positive for DH.
We have now received a letter stating that:
I am unable to recommend that your complaint should be upheld. I am satisfied that Nationwide adequately explained that the policies were entirely optional. Whilst I have not been provided with any evidence to show that the Nationwide representative explained this to you during the telephone call on either occasion, this was a two-part sales process and both loan agreements signed by you clearly refer to the insurance as 'optional'.
Now, DH is obviously very unhappy. This is a true PPI case in that DH clearly remembers being forced to take the PPI - his Dad was with him during both phone calls and remembers DH getting upset about having to pay extra on top of the already high loan repayments. DH felt he didn't need it as he still lived at home and his Dad would help him out if any problems etc. Both times on the phone Nationwide said that he simply would not get the loan without the insurance.
DH doesn't agree that just because it says 'optional' on the forms that he has signed then this must mean he was OK with it. Quite simply - he had already been told he had to have this PPI to get the loan - whether they stated it was optional or not.
(on another note I myself had a successful PPI claim without going through the ombudsman last year and had equally signed a form that said the PPI was optional, but I signed it because I was told I had to in order to get the loan).
Clearly DH is not happy and we assume the next step is to ask the Ombudsman himself to look at the case. They've asked us to supply any further evidence that may help - unless they'd take a 'witness statement' of sorts from DH's Dad I don't know what else we can provide.
Has anybody had any experience of this? We feel so disappointed, as this was a definite case of PPI mis-selling that it looks as though Nationwide will be getting away with.Thrilled to be DEBT-FREE as of 26.03.10

It seems to be there have been a few rejects recently by the FOS.
Did they offer to move your case over to the Ombudsman himself?
Just a thought, if this was sold over the phone, wonder if they still hold the copy of the recordings.
Did you request for a Subject Access Request (SAR) from the company?
This should include how the policy was sold, and anything in relation of the PPI.
If this was taken out the last 6 years they should still hold the details to what I am aware of.

It does say that if we disagree with how he has reached his conclusions to reply by 11 November telling him the reasons and any evidence we may have that has not already been provided. It says we will then also have the right to ask the ombudsman to review the case as the final stage in the process.
The loans were taken out in 2003 (so 7 years ago).
We didn't request the SAR from the company, as it all seemed a bit pointless. DH remembered signing the form that stated 'optional PPI', but there's obviously nothing on that form that tells you that they'd told you verbally that you wouldn't get the loan without accepting PPI.
For both loans it is stated in the Adjudicator's letter that 'Nationwide have been unable to provide a copy of the sales recording due to the amount of time that has elapsed since the sale'. Funny that ... (and heaven knows what the 400-page document was that the Adjudicator said he had to read?!)Thrilled to be DEBT-FREE as of 26.03.10
