He wasn't aware he had it but that doesn't necessarily mean he didn't know in the first place that he had it!!! He applied by phone so can't remember what was said, but I would have told him to say no, lol

lol yeah me too, but you know what banks were like, they would just add it anyway, so its a possibly reclaim for your hubby, and its unlikely it was even mentioned on the phone (i know i could be wrong) but you never know.
Wonder if they will provide a copy of the telephone conversations?
How long ago was this taken out? x

Probably about 3 years ago, not sure exactly. I've just noticed it was a balance transfer and he didn't move it on so interest obviously added. I seriously need to take over the monitoring of his banking!!!

    Maybe an SAR would help?;)

If it was taken out with his bank then you just need to write the bank account number, the SAR should provide all accounts he have taken out with them. X

  • Hi
Has anyone had dealings with trying to reclaim PPI payments from Capital One?
My other half is pursuing three claims, one from Halifax which paid out without any argument, one from Liverpool Victoria (LV) which quibbled a bit then reviewed it and paid out and one which is ongoing with Capital One.
We've had a letter back from them today saying they have found no evidence of the policy being mis-sold.
    However.
The letter sets out step-by-step the process that he went through (ie you applied on his date, it was approved on this date etc) and states:
"You ticked "no" on this form to indicate you were not interested in adding PPI to your account when it was approved. You then signed and returned your paperwork on 5 December and your account was opened on 8th December. You then purchased your PPI policy on 14 December over the telephone whilst calling to activate your credit card"
    It goes on to say:
"At the time you requested PPI you were XX years old, employed by XXX, earning £XXXXX, living in XXXXX. THerefore you met all of the eligibility criteria for this product. CApital One did not provide any advice or recomendation about the product, it was the customer's responsibility to determine if you were eligible for cover and whether the policy met your demands and needs".
Are we right in thinking that the very fact that he ticked No on the form for PPI and was then badgered into it on the phone is itself proof the policy was mis-sold? Or have we missed something?

Hi there, if you feel this ppi was pushed onto you (as i know that is what happens when you phone to activate the card, and the person you are talking to will go on and on about why you should take this)
Get in touch with cap one and tell them this, as you did not want it and had ticked the no box initially you were mis sold and you will be going to fos. This may make them think again, it may not but it is worth trying.

i received the exact same letter earlier this week so ive sent them the follow up letter off this site 2 days ago pointing out that i had already declined ppi twice so just gotta wait and see. Oh yeah watch out for welcome as a new delaying tactic for them is to say that the refund form was returned unsigned!!!

i recieved this letter from the f.o.s. today, is this what the banks are putting things on hold for or is it something else ?

i am writing to update you on the case you have asked us to consider.
we asked citi financial for its comments on the complaint you raised and it questioned our jurisdiction to investigate the case.
our jurisdiction (or authority) comes from the rules under which the the f.o.s. was set up and i am currently investigating whether, in my opinium, these allow us to consider the issues you have raised. it may be necessary for me to contact you for further information to help me reach a conclusion.
if i believe that we can continue,i will tell citi financial and ask it to provide any further comments in connection with the issues you have raised. if i agree with citi that we do not have authority, i will write to you with an explanation of how i came to my conclusion. if either you or citi disagree with the outcome i have reached, the case can be referred to an ombudsman for a final decision.

the claim is for a ppi and has allready been with f,o,s, for one year, the letter seems to be a bit vague. any thoughts please
