PPI Reclaiming Discussion part 4

Hello Di,
Hope you are well?
I am still fighting Lloyds against the way in which they worked out my redress.
My MP has written to Eric Daniels on my behalf asking it to be reconsidered.
The strange thing is that the FOS told me that the 10 year rule was agreed between Lloyds and the FOS yet, 2 days ago, I was informed that the Ombudsman has requested paperwork from Lloyds to clarify what method they used to calculate my redress and the same Ombudsman who originally found in my favour, will make a ruling to decide whether their working out was fair or not.
I paid £6,500 in PPI between Jan 2000 and August 2007, at an average of £72 per month. Lloyds used the last statement they had on record to determine what they paid me back from December 1999 back to October 1987. The PPI payment in Jan 2000 was £12.00 so they used this figure to apply to every month for the previous 13 years!!
I have told them in no uncertain terms that this is an untried, untested, unjust and unfair calculation and I want the average of £72.00 per month they have on record applied to each month from Dec 1999 back to October 1987, not £12.00.
I can think of no where else on the planet where an average figure would not be applied and I used the analagy of a golfer trying to get a handicap whereby if he played 10 rounds of golf scoring 24 over par and the last game he played was 10 over par he would get a handicap based on the average score over the 11 games. The way that Lloyds have approached my claim would be the same as giving the golfer a handicap of 10, based on his last game!!
I have also complained about Lloyds using my redress money to clear my credit card debt with them, and then reducing my credit limit, all without my consent, and then having the cheek to pay the balance into my account!
The 3 letters of complaint I sent to Lloyds at the end of September (all recorded delivery) have not yet been responded to. At least my MP replied within 2 days and sent his letter to Eric Daniels within the next 3 days.
I will of course keep you updated and, as I have said all along, if I have to take Lloyds to court to defend my rights, then I will.
I strongly believe that I have been treated unfairly and I also strongly believe that Lloyds TSB have acted unlawfully. It is now over 3 years since I started my fight against them and the battle is not over yet.
Hi,
I have just read your post with great interest.
I am in a similar position (but not as far down the line as you)with a number of accounts going back into the mid nineties and 2/3 mid to late eighties.
I have the last 10 years statements for all accounts and the longest standing account also has had the biggest outstanding balance / PPI charged.
I fear that(If my claims are upheld) they will do the same to me.
I wish you the best of luck and will be keeping an eye out to see how you get on.
Fingers crossed.

Hiya
Yes from a few posts on here, its been confirmed there have still been payouts on the resolved cases, and where acceptances have been completed etc.
Contact them and make them aware you know people in the same situation as yourself have been receiving their refunds.
Good luck, please keep us posted.;)0 -
Well done everyone who are having a go, I hope you all get successes.
My little situation is not over yet and is getting more and more confusing by the day!!
Basically, my complaint was upheld and a month ago I was sent a cheque for full amount (without 8% interest) I paid it into my account but it was sent back unpaid, apparently I should have paid it to the loan bank for them to take off loan.
Cheque sent back with letter dated 20th Oct, on same day I had a letter from different department dated 13th Oct saying they were paying the full amount plus 8% interest directly off my remaining loan and my payments would be the same for remaining 24 months!
I rang and they agreed to pay off loan with the full amount, which leaves about £1200 left to pay so I asked them to change my payments ~ they didn't seem to have realised they should do this!!
Anyway, I rang Monday and informed them the loan money was still in my current account with another bank even though cheque was returned, they said the money had not been cleared their end and wouldn't be...it's now Friday and the money is still in my account!!!
I'm not ringing my bank just yet about it until the loan confirmation comes through, just in case they've cocked it up again.
Bizarre or what??0 -

Hiya
Hope your well.
OMG yes very bizzare.
What baffles me is why did they send the cheque in the first place and not deal with it like they should have done first time round!
Was this Lloyds?
Good luck with this and please keep us informed. XThe one and only "Dizzy Di"0 -

Good luck, we look forward to hearing the outcome of this.;)The one and only "Dizzy Di"0 -

No it was Nationwide. As I said, I've had letters from different departments, so I'm not confident that they know what they're doing!!
That money looks awfully nice in my account, I can't believe they've effectively paid me twice. I await the next letter...0 -

They certainly don't know what their doing do they?
I bet it does look nice in your account.
I assumed if there was anything remaining and any interest should be awarded directly to you.
Yes, good luck on the awaiting letter, please keep us posted.;) xThe one and only "Dizzy Di"0 -
I've been filing some old paperwork and found that my hubby used to pay PPI on his credit card. I'd totally forgot that I told him a while ago to cancel it. Could he still claim if he cancelled the PPI but didn't file a claim straight away? He can't remember when he cancelled the PPI as the statement I have is about 2 years old ~ he usually bins his statements as he's just paying it off and not using the card, very helpful!0

He wasn't aware he had it but that doesn't necessarily mean he didn't know in the first place that he had it!!! He applied by phone so can't remember what was said, but I would have told him to say no, lol0
