    Afternoon,

I was wondering whether somebody could advise me of what steps to take. I sent my FOS questionnaire to MBNA back in August. They sent me several stalling letters saying they were looking into my complaint. I had clearly ticked "No" to credit card PPC and they added it anyway. I was due a response by today and got a letter stating that my complaint is on hold as the BBA has sought clarification from the Court concerning complaints handled by the FOS.

They have enclosed an FOS leaflet. My question is do I send all the documents to the FOS and can the FOS still deal with my case or do I have to wait for the courts to decide as in the bank charges which may be many, many months?

    I'm confused.

    Hi Anna

Sorry to hear this, but as your complaint was one of those before all this came into action, I assumed they would continue, it was stated that only those of brand new complaints would be affected.

I would give the FOS a ring on this matter now and see what they suggest.;)
Good luck and please let us know.

Quick Update - I have just spoken to somebody who was quite lovely at the FOS and was advised that as far as the FOS are concerned, companies that send out letters after a complaint has been lodged citing the recent court proceedings are acting illegally. If you have sent the questionnaire off as I did in August and the Bank/CC Company do not respond (after the 8 weeek deadline), you can then send your questionnaire and any supporting documents directly to the FOS. The FOS are not taking any notice of the court proceedings.

    Hi there

Was these the ones who set up your policy?

If mis sold and they were the ones who arranged the policy then you pursue them, you can do this by completing the reclaiming questionnaire as shown on link below.
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance#reclaim

Keep copies of all you send and receive in case you need to refer to them at some point.

Hopefully anyone who have had dealing with this company will also post up of their own experience.

Good luck and please keep us posted.;)

    Hi there
To what i know of if your complaint is already with the fos, especially before all this came about then you should be okay, you can check directly with them and they will confirm, my hubbys was okay.;)

    Hi Kai,

I spoke to the FOS this afternoon and they are pretty much ignoring the freeze. If in doubt give them a ring, as they were incredibly helpful.

  • Phonecall after phonecall, letter after letter, trying to verify information given out by LloydS staff, I today received my PPI payout of £4800.00. I was told only last week by inept LLoyds Tsb staff, that even though both of my claims had been upheld and the signed paperwork had been received, they would be witholding all payments. B******s.
So all you peeps out there who are awaiting your payout...don`t lose hope, it sets a precedence that once one is paid others must have to be.
Good luck to each and everyone of you and thanks to this forum for all information
I too have been fobbed off by Lloyds. Sent a letter claiming ppi on 2 loans. Recieved letter saying my claim was upheld on one. Sent back acceptance. Rang to find out what was happening about other loan claim. Was told it had been "overlooked" and now was on hold. Since then have heard nothing about either. Lloyds giving conflicting information so wondered with your success if you had any advice. well done on your success:beer:
