    In fact page 5 of this leaflet (on Sale of Goods Act) states that if goods don't match the description then they ARE faulty!
    You have a legal right to repair, refund or replacement. repait is not relevant; thay are unable to provide a correctly-sized item so you're entitled to a refund.
    You're right. That's a brilliantly clear document, which explains my exact situation of being unable to measure in shop, getting home, realising wrong size, and returning. I've not had time/opportunity to measure the goods in store, and returned at first available opportunity.

    Thanks also to Kite2010. I'm emailing them now on cs@sportsdirect.com (listed on their customer service twitter account). I presume they won't be there now until Tuesday now, but it's good to start something.

    There is a part of me that has already considered just keeping the suitcase (which was actually very reasonably priced), but I don't like to see these sorts of companies bully people into getting their own way, for what is essentially their fault/mistake (mislabelled products).

    If no luck with getting an email back from customer services, just make an entry onto Twitter.

    If a complaint goes out, you are more likely going to get a response back, sad at it is.

    Other shops don't have these problems to the same extent. Therefore I think you need to turn your anger onto your managers. It is they who impose cramped conditions in your stores, poor terms for customers, and trying to avoid their legal requirements.

    It's just as well that you don't make the rules seeing as you have openly admitted to not following (or not understanding) UK legislation relating to consumer rights over faulty goods.

    Lest we appear to be talking to ourselves, it appears the post to which myself and shaun have replied has been deleted.

    For the record it was a rant from someone allegedly employed by SD, blaming customers for all the ills of the shop.

    I wondered where that had went to! I wrote a beautifully long [STRIKE]rant[/STRIKE] reply back at him, and that appears to have disappeared too, maybe because I quoted him perhaps?

    I thought I was cracking up! :rotfl:

    No, my reply to him seems to have gone too.

    Ridiculous over-reaction though to delete those comments. I see much worse on the forum and they are ignored.
  • I would never shop in SD again either. Some time ago I bought some gym trousers from a London branch, their fitting rooms were out of use so I bought them and tried them on at home knowing they "don't do refunds" thinking I would exchange them for the next size.

    Anyway, when I took them back to exchange them, the woman on the till sniffed them, said that they smelt of soap powder so therefore I must have worn them, washed them and skilfully put the tags back on! I questioned how I could have put the tags back on, and how come the layer of dust was still on the legs from their filthy shop floor, but she couldn't explain and wouldn't swap them.

    So I took them back to another branch when away for the weekend and swapped them no problem.

    It still put me off the shop for life though.

    (I work in retail customer service, and I'd be sent for retraining if I was as unhelpful as this at work.)

    There didn't seem to be any tape measures at the tills, and there was a queue, so as the label clearly states it is a long way within Easyjet's requirements, I bought the case.
    When I got it home and measured it, it is quite a lot larger than the label suggests.
    The actual size of this (all encompassing) is: 59.5 x 39 x 17 cm.
    Even if you exclude the wheels and handle (although they aren't removable without damaging the case), the size of the material case is: 54cm x 38 x 17cm. Still bigger than specified on two of the sides.

    So realising this wouldn't be any use to me, today I attempted to return the case, but was told they could not issue me a refund, as the product wasn't faulty, and they "don't do refunds" except if they're faulty.
    I admit I was taken aback and said "is that even legal?"
    She told me they comply with the law, but don't do refunds (unless the items are faulty).
    However, with no obvious way to measure the product in store, and written sizes clearly listed on it, surely this is a product which is sold "not as described"? And thus breaking the law under the sale of goods act?
    I declined the offer of an exchange (there is nothing else I want to buy from this company - it's mostly gaudy leisurewear), and am now continuing my search for a refund.

    Any thoughts? I think I'm in the right here.

    Arhhhh I've just had the same issue with suitcases!!
    I ordered the 17" Dunlop cases, 4 of them. There were no sizing on their website for these but there were measurements for the 16" and the 20".
    Knowing they would be bigger than the 16" yet smaller than the 20" I knew they would be perfect for Ryanair.
    16" Measurements:
    47cm x 34cm x 16cm
    17" Measurements:
    43cm x 30cm x 13cm !! Way tooooo small!! I immediately emailed SportsDirect as there are no telephone numbers on their site but have yet to receive a reply.
    Reading through their returns info I realised that I should return these 4 suitcases via Royal Mail Recorded Delivery, even though they were delivered via Yodel ! Geee it's going to cost more than I paid for the goods!
    Anyway, finally found contact details on this site (thanks) and have just rung 0870 333 9400 (the other number given here is not working) and spoke to a lovely lady :) I asked if I could return to store & was told they would only give me a credit note not a refund so she is arranging collection this Friday and said I will be refunded in full.... HOPE SO!!! Definitely false advertising!!!

    Also wanted to add that if you check their reviews, which I did when purchasing the suitcases, they only post positive ones.. It says there are maybe 12 reviews but actually only 6 showing. When I tried to post a review it said it would be vetted first! How is that a true review...... :cool:
