It's an element of theft that the action involves "dishonesty". If you plead that the action you took wasn't dishonest, that is a defence. But you need to show not only that you didn't believe it was dishonest, you also thought that people in general didn't think the action was dishonest.
its all about deception

That happened to me once when I was leaving Harmony on Oxford Street, and yes they did come and look in my bags. It was soooo embarrassing, especially as it was the day before my honeymoon and I was feeling experimental.:o:D

fortunately i didnt have any, but other high street stores have questionable voucher policies, like an expiry date (wh smith)
i think the current situation with many stores going bust i would not give anyone vouchers, and if i were to receive any from any store i would be spending them sharpish.Member no.1 of the 'I'm not in a clique' group :rotfl:

where I am fully with epz is on the fact that they have basically stolen from you in this situation
They haven't stolen from you. By buying the gift cards you loaned them cash, with the understanding that they would pay you back in goods. They now are in administration and are not in the position to pay off all their debts, so have defaulted on the loan. If they are thieves then so is practically everyone on the Debt-Free Wannabe boards. And you can't just walk in and take goods any more than the bank can walk into your house and take your TV if you owe them money.poppy100 -

Because, in effect, you have lent the money to the company in return for a bit of paper that promises you £x worth of stuff in exchange for it. The voucher isn't cash in itself, because you can't use it elsewhere, as general cash. So the company in effect owes you money. If they are insolvent, you get into the queue of people owed money.
That is how I understand it, but I could be wrong....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -
The police will do them for wasting police time if they try to prosecute you for paying for goods from Zavvi with a Zavvi gift voucher,
I sincerely doubt that the police would do any such thing! And I'd be very wary of stating with such certainty that the police would act in such a manner....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -

It's not. You are looking at the wrong Theft Act. The definition of Theft is contained not in the 1978 Act, but in the Theft Act 1968. s.1.(1) of that Act provides:
A person shall be guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it.
The 1978 Act isn't relevant to the basic definition of theft....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -
But ultimately that is what happens to bad debtors if things get to the bailiffs stage.
Not necessarily. That is after court orders etc have been obtained, not just the person who is owed money strolling in to a debtor's premises.
And if a person is bankrupt (similar to a company being insolvent) then the creditors have to be treated equally....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0
