    to be honest, i feel that if they won't honor the vouchers they are effectively defrauding all the people who have purchased them, and i'm one of those such mugs. They must have known when they sold them that they were in trouble therefore have traded fraudulently. I hope the company directors are sued for what they have done to the general public

    Totally agree with this.

    Do not threaten or abuse staff, that's not appropriate at all - they didn't make the policy, but provided you have the receipt to show the value on the card; help yourself to goods to the value of; and then unceremoniously SLAP the gift card on the counter and walk out with the products. I would not think twice about doing this if I had a Zavvi gift voucher.

    AIUI, the administrators have said they will refund those bought after X date, it's those which are older which are worthless.

    I can understand a closed business but not an open one. That's disgusting.

    It's not "disgusting", though. You have to bear in mind that the administrators have a duty to avoid preferring some creditors (old voucher holders) over other creditors (suppliers, etc)

    I can't see that. They were sold as vouchers, and were fit for purpose when sold. The fact that the company is now bust doesn't come in to the Sale of Goods Act.

    There is no crime of "shoplifting". It is theft. And theft is not defined as taking an item without making an attempt to pay. The definition of theft is appropriating property belonging to another with a dishonest intention of depriving the other of it permanently.

  • Even if you were caught, there is a legal defence that you honestly did not believe that you were stealing. It's a little known defgence.

    It's an element of theft that the action involves "dishonesty". If you plead that the action you took wasn't dishonest, that is a defence. But you need to show not only that you didn't believe it was dishonest, you also thought that people in general didn't think the action was dishonest.

    In general I agree with your point - you're saying that you have been told that something is no longer acceptable as a form of payment, and therefore should be morally obliged, on the gounds that stealing is bad, to go along with it.

    However, where I am fully with epz is on the fact that they have basically stolen from you in this situation; and ergo the "What are they going to do about?" argument. The police will do them for wasting police time if they try to prosecute you for paying for goods from Zavvi with a Zavvi gift voucher, which leaves the civil route which would almost certainly end up costing the administrators more than the value of the goods and voucher combined; and they won't want that coming out of their fee.

    So just make sure you've got a route past security (for logistical, not moral reasons!) and then go for it!

    id love to know more about who someone who has exchanged cash for a token is an unsecured creditor. its not like we have supplied with electricity or anything.

    What will be interesting to see is as they have gone into Administration the majority of their contracts will terminate immeadiatly so things like the tills, the overdraft, the air con maintenance, the computer repairers, the network etc etc may well get shut down and they wont be able to trade at all.
