The National Consumer Agency in Ireland have been very helpful and have passed the details of my complaint on to their Commercial Practices Division.
They have also advised anybody who believes they have received counterfeit or fake goods from Fred Penny to contact the National Bureau of Criminal Investigation. They can be contacted on;
The Anti-Racketeering Unit of the NBCI,
Harcourt Street,
Dublin 2
Tel: 01 666 3381
The Garda website says;
"The protection of intellectual property rights is the primary function of the Anti-Racketeering Unit. To ensure a structured and co-ordinated approach in tackling the problem of counterfeit products, the unit liaises on a national basis with investigating Garda! and assists in all aspects of this particular criminality."0 -
Its always a suspicious sign in my opinion when they refuse to put a name and address against their IP whois information

It gets worse for me. The one 'iPod' I did receive does not work at all. Seems that was a fake.
Anyone got any advice on how best to get my money back?0 -

If you paid by credit card and the item was over £100 then get on to your credit card company as Section 75 of the Consumer Credit Act makes them equally liable. If not get on to trading standards although the latter action is unlikely to get your money back."The whole problem with the world is that fools and fanatics are always so certain of themselves, but wiser people so full of doubts."

As the OP I would like to point out to you both - no its not 'funny' and we are all human -- The prices he shows are cheap but not ridiculously as so alarm bells would ring.
- Availability on the brand name items is not difficult - go into any small exclusive boutique and they will have at least one 'name'
- All business start somewhere
- I have used websites that are patently obvious non native English speakers without problems
- An address and phone no was provided
- AS for helpefully posting the URL - No one googles a URL!! When I searched 'models and modistas' to check reviews/feedback after originally finding site (googling cheap ipods) it did not come up with anything other than the site itself. Trying it now of course brings up a different story, due to this thread and cayoutrustthem.com!
However it's not appropriate here as of course we all now know the information that you so graciously pointed out.:doh:
Perhaps you would like to start your own thread(s) and assist others before they make our mistakes.?!
Hope that you all can get together as there is definitly more power in numbers. Thoughts to you all that you can put him out of business

All business start somewhere?! Not when you get a reply from them saying: 'You picked the wrong guy to threaten pal!!' what sort of business responds like that. That was the response someone got when they said about reporting them to trading standards.
I'm still awaiting delivery of an item I paid over £200 for and it has now been 37 days since purchase date.0 -

dont know if you read the reason why i posted my reply :question: but i was defending (our!) reason for buying from Mr Penny originally!
Yes i agree no business under any circumstances should respond to any customer in that manner, and indeed would not stay in business very long, which is why i suggest you pm others who have taken action to assist you to reclaim what is owed to you..
I appreciate that I was very lucky but it still makes my blood boil that anyone should take money for goods they have no intention of delivering or as others have pointed out potentially fake. And even more so when others point out the obvious - i.e. our gullibility.:mad:Greyer by the minute - Older by the hour - Wiser by the day0 -

westiea - Yes sorry, I was so angry when I was writing the reply.
Luckily I have just spoken with my CC company and they said they will refund me the money. That will teach me to jump at a bargin in future.
I still have put a complaint to http://www.consumerconnect.ie/eng/0 -
