I too have fallen foul of M&M. Much the same story really as the others, ordered an iPod Shuffle on the 10th December, had an e-mail from WorldPay but nothing from M&M. Sent an e-mail straight away and got a reply saying he'd received the order. Money got taken out.
No word at all from them until a few days before Christmas when I asked when delivery was going to be, he said it would be Tuesday down the post office because thats the only day they do. Tuesday came and went, no notification of postage. Sent another e-mail, no reply at all. Sent another e-mail to ask if is going to be here before Christmas otherwise I'd have to go and buy another one just so the person I was buying it for would have something to open on Christmas. No reply.
E-mail's were sent after christmas, still nothing at all. Finally received the "iPod shuffle" on the 11th Jan. It has a post mark of the 9th Jan so the problem with postage isn't the "large delay in christmas post at the post office" at all. Also, the box was completely smashed in a jiffy bag only. It was already held together with two elastic bands so I think i've been sent a returned good from before! To put insult to injury, it's a fake. The packaging is all wrong, the buttons on the iPod are all wrong, there is no shuffle button! On an iPod Shuffle?! Also, the look of it is tacky and the clip is terrible!
I've e-mailed him again asking for a full refund, not only because of the smashed quality, the fakeness of the iPod, the manner in which it was all received (they left it under my car in the drive so wasn't sent recorded at all!), and also the time it took from when I bought it a whole month after purchasing! True to form, I've had nothing back at all from him.
Claiming from WorldPay seems to be a laborious task and I'm wondering whether or not to let Apple know that he's selling fake goods as legitimate ones. Anyone got any recommendations?0 -

I placed an order with this company on 13th December 2008. Received an email from worldpay confirming payment and 1 email from the company to say goods wouldn't arrive until week after Christmas. I have still not received the goods despite several emails and phone calls (can only get through to an answer machine). This company doesn't even give you the courtesy of a reply. I don't seem to be getting anywhere. Written to them requesting a response within 7 days and a full refund if goods not forthcoming. BEWARE think twice before ordering from this company.
UPDATE - I finally sent them a recorded delivery letter (and sent a copy by email) giving them seven days to either send the goods or give me a full refund otherwise I would take them to the small claims Court and although they never responded by letter or email SURPRISE SURPRISE I received the goods within seven days. I can't believe my luck - but I definitely wouldn't use this company again!!!!!! They need to get their act together and contact customers and let them know what's happening.0 -

47 days since ordering - no item and no contact
I ordered and paid for a 2GB ipod shuffle on 5th December as a Christmas present.
Having received my Worldpay confirmation, but no order confirmation I immediately became suspicious. I emailed Models and Modistas, but received no response. I called, left a voicemail and did not get a reply.
I found this site, and read the comments posted, including the response posted by Mr Penny himself, and felt maybe I was being unfair to him and his company. So I waited.... patiently... waited... and on 13th January decided I had been patient enough and contacted Models and Modistas again.
Still no response, so I emailed again and again, and again and still no response - Despite informing Models and Modistas that failure to respond to my final email would not only result in me adding to this thread, but also contacting The National Consumer Agency and the European Consumer Centre.
Guess what? That's right, No response!!
So, here is my post, and shortly I will be emailing both the NCA and ECC, as promised !!0 -

Ok peeps,
shortly after posting my woes last night, I emailed M&M for the very last time...Well Models and Modistas,
Still no contact from you.
As per my previous email, I have now posted my complaint on the Money Saving Expert forum and raised a complaint to the ECC and NCA.
If you do happen to read this, please cancel my order and process a full refund - Should I receive a refund, I will update my post and complaints to the ECC and NCA to say that you have (finally) got in contact, and provided me with a refund as I have requested.
And... I am pleased to announce (? pleased.. maybe more relieved !) that 6 mins later I received a WorldPay refund notice for the full amount.
So, as I am a lady of my word, I am letting you all know - Although I have still not had any contact directly from Mr Penny or anyone else at M&M !!
And as soon as the ECC, NCA and Watchdog get in touch, I will let them know the same.
It's a shame it came to this, but at least I got my money back !!

I purchased GHD MK4 Purple ceramic stylers, they were paid for through World Pay. I was advaised that there was a current shipping time of 10-14days. I email again and was advise they would be shipped 18/12/08. I contacted them again and recieved an email on the 06/01/09 to say that they had just started back after the Christmas break and that my item would be shipped on Friday (09/01/09) and that I should have the item by the middle of the following week. They did not arrive. I have sent 3 further emails with no reply and still my order has not arrived. I have requested a full refund and now the seller does not seem to want to get in contact.
It seems to me that this is not the first time. Is there anyway I can retreive the £125.50 I paid through World Pay on my Credit Card?
I am extremley angry with this chap, Fred :mad: and would advise anyone who is thinking of purchasing an item from this mickey mouse company not to take the risk! It really isn't worth the risk in my experience and seems a rather large number of people would agree.0 -
Thought I'd update you all....I've managed to get a full refund from WorldPay who I hope will take heed from cases like mine and stop allowing this muppet to con money via their service. :mad:
Have to add that I was lucky that I used my CC so was able to initiate a claim under section 75 of the Consumer Credit Act. :money:
Good luck to you all and don't give up on bringing 'Fraud' Penny and his M&Ms website down - I certainly won't!0
