At the moment we can't do anything until MFI actually say they aren't delivering. We were wondering if we can tell MFI (politely) what they can do with their kitchen - in other words CANCEL. If we do this can weour money back from the credit card company?

Also paid £3500 by CC for our kitchen due for delivery on 20/1/09. Worked in banking complaints for 20 years (defending cases that went to the Financial Ombudsman Service) and familiar with S75 claims and have been wary about the reassurances about getting money back all along due to the single item limit of £100. Most items are listed as less than that so won't be surprised at all if our claim is declined, tho if this happens everyone should pursue all the way thru to the FOS (CC companies will often try to use loop holes in the law to try and get out of claim but doesn't cost you anything to pursue in this way).

I have decided to look at the cancellation option (which mfi obviously won't agree to). However, I'm thinking that once they've declined my cancellation request (in writing), it may be possible to claim on my CC for breach of contract as per their T&Cs. If successful I would only get full cost, less 10% as per MFI T&Cs, but that would still be more than if I only got the amount for items more than £100. Plus then I can move on and get another kitchen ordered as opposed to waiting until 20th Jan. If claim is declined then I could still try to claim under non delivery of goods at a later date.
Worth a try I think. Keep you updated with progress.

We paid £1700 deposit on our credit card, which means I would think that there is nothing itemised anyway, ie nothing under or over £100, if you see what I mean, do you think that the credit card company could wriggle out of that one?

    What a mess!

Hi I read on one reply not to fit any units we may have. Does this invalidate a request for a refund if we start to fit it.
We are missing the mirror panels for 1 sliding wardrobe door but have the rest of the order. Was going to fit it and try for a refund for the useless wardrobe and see if we could get a local glass co to make up the panels so the rest of the furniture isn't wasted.
Woudl we be better doing nothing at the mo? MY daughter is living out of boxes and its starting to drive me mad. (I appreciate others are in worse positions than me!!!)
    Thanks,
    Claire

    Hi everyone,
its not looking good is it? I wish they would update that website!!
I have asked this before but no-one has responded, so I thought I'd ask again just in case anyone does know........
We bought an ex display kitchen from one of the stores closing down. Paid on our credit card and obviously received the lot. We were assured by staff that we could go to another MFI store nearby that was staying open and order more units to go with the display stuff. This we did. We made another order and paid by visa debit and then changed our mind a couple of weeks later and went back to the store changing one unit and adding more cornice and pelmet. We paid them more money on our visa debit card. These orders should be delivered on 10th!! We have half of a kitchen installed. Can anyone recommend which course of action I should be thinking about. As we paid for the original units on our credit card does this cover for the other 2 payments made a couple of weeks later - or would they be seen as separate purchases? Should we therefore think about the chargeback process? Any ideas would be really appreciated. Thanks for reading.............off to check the MFI site again!

i have a integrated washing machine APM 8512
i need the hinges to fasten on to the decor panel (door)

anyone know where i can get them from please:confused:

I bet you could get these from any kitchen fitting place - have you looked at the Howdens site?
  • This may be a really stupid quetion but given what MFI seam to have gotten away with so far, nothing would surprise me......If they do by some chance have our furniture, is it possible for them to then sell it a second time, whilst leaving our orders unfullfilled?

I live in a small vilage only ten mins away from the Thorne Distribution centre, i think it's their Flag Ship centre. From the information recieved from the administrator's (ie the phone code 01405) i would confidently say its also where they are based.

This building is HUGE!! Several football pitches and mainly warehouse space there must be hundreds of undelivered orders just sat there!!!!!!!
    THIS IS SO UNFAIR!!!!!!!!!!!!

    Hi,
I know what you mean. I would gladly go and collect it myself if the option was there. I just want to know something one way or another. I think we can assume we won't be getting any delivery on 10th. I suppose I should just crack on and order from Howdens?

According to the statement on the MFi website they have over £40 Million worth of stock however their supplier have first dibs on anything unpaid.

Therefore... it is not as simple as "the stock is there waiting for you".

My understanding is that SLate (Black Horse) is a credit agreement, and falls under S75, so Black Horse will be jointly and severally liable with MFI. In your position, from the note from the administrators posted above, orders for delivery are cancelled, so don't expect to get them. Keep a meticulous record of what you have paid extra and exactly what for. When it comes to any claim, you will be thankful for this detail.

On the positive, the kitchen is fitted - on another positive, you may not start paying the Slate agreement for 3 months - need to check small print, but if the kitchen isn't correct... time to start looking at the not content route...

I'm no expert, but I would suggest that you are in a stronger position than many...

Many thanks Monstercop, will give claiming under s75 a go.

I'm looking for the Camden range of Wardrobes. If anyone knows where I can get similar wardrobes I'd be really grateful?

I went into my local MFI yesterday in the hope of getting something in the sale but nearly everything already had a SOLD sticker on it. I think Staff and their friends and family had first choice (which is fair enough given the circumstances) And all that was left were a pile of sinks, odd wardrobe doors, kitchen cupboard doors and a few taps in the middle of what is now a very big empty hanger.

I spoke to one of the staff on Friday who had said optimistically that he thought the store would be open for a few weeks but I think this store will definitely be shut from tomorrow by the look of things.

I've had my letter from administrators and still live in hope that they might get orders out if possible this week? If anyone gets a delivery please let us all know asap.

Thanks guys! Good luck to all those waiting for orders or hoping to get a refund. And more importantly my thoughts are with all MFI staff. Here's hoping the administrators can save jobs if possible.

MFI Rotherham Tel 01709 780217/8 had some double Camden Wardrobes and corner shelf unit in their warehouse end of last week but they were the tall ones so you would need to check the size suits you if they still have them . They did them in 3 sizes and I am looking for a double in the 209 middle size if anyone sees any. Keep ringing till they answer

Hi, I believe you will be fine as a deposit isn't technically paying for any one item i.e. how do the cc company define what items the deposit is for. Whereas in my situation I've paid in full so they can look at the cost of each item. I don't think there is any way they can wriggle out of your situation, and in the unlikely event that they do, just progress the claim through their complaints procedure, and if that fails, to the Financial Ombudsman Service. A lot depends on which cc company you're with and whether they play fair.

Anyone taking this course of action needs to be prepared for a long drawn out complaint, but it's totally worthwhile, as it's free and the FOS are completely impartial.
