the plot thickens... received an email back from him, and another picture, comparing my pic side by side with another one he has taken...

Email :

This is definitley your mobile. IMEIXXXXXXXXXX. I have made a comparison and fortunatly you can see by the white chip in the left corner of the No.6 key.
Thanks for your offer of a refund but I feel the postage charges make it uneconomical to return on the price of this item. Thats why I suggested a small refund.

=== end of email

I can't seem to save the pic and post it here , so i have asked him to resend it.
But the pic does look very much like my mobile, with a small crack on one of the keys. Interesting, because i dont remember the keypad to be cracked at all when i sold it.

He is still insisting on a small refund. Am I being picky if i ask him to send it back for a full refund, via recorded delivery?

Tell him that you can't refund any of the money unless he sends the phone back, as you need to inspect it. I know you've already said something similar, but just re-iterate it. The worst he can do is leave a neg, and when buyers see a neg they usually see why and see that this guy is a bad ebayer anyway. You could also report him to ebay if you think he is trying to con you, see if they do anything.

well for all its worth from me.......there seems to be damage to the bottom part of the phone which he sent you a picture of (dents and scratch) and yours clearly does not show this on your auction pics supersized.

have you or can you use picasa?(SP) to sharpen your photos? free downloadable

i would also ask this seller how damaged was her phone scratches / etc - her auction is not very clear

And why is this guy bothering for only a tenner?

I

It not just a tenner though is it - its a tenner from you (or £5 if he wants a partial refund), a fiver from the next seller, a fiver from the one after that etc etc, it's quite a 'clever' way of getting things very cheap. Tbh, I wouldn't refund unless he ret'd the phone - if he negs you you can leave a follow-up advising ppl to check the fb he has left for others and it won't have any effect on you as ppl will see what he is like.

first, I would send all emails etc you have on this to ebay
second, only deal with him through the paypal dispute console
third, tell him you've caught on to his game and have reported it to his local police, maybe a bit OTT but if you have the tiem do it for real

worrying about getting a red dot is no excuse for letting scum like this ruining ebay.

because the idiot is complaining and i dont want negative feedback. If you were in my situation, would you really tell him to s*d off and get a free negative in return?

Fair point.

Although I would tell him where to go, but then I've had 3 accounts suspended thanks to theif buyers....

Its about time ebay started protecting its sellers, after all sellers pay the rent...

Now I'm more confused than ever. This is the latest pic he has sent me (my auction pic on the right... his version on the left ...

Time to be firm with him and present him with the games he's been playing with previous sellers, and the option of sending the whole phone+box back for a refund ?

keyze8.th.jpgthpix.gif

This is the email (or words to that effect) I want to send to him ... opinions?, or should I just open a case with Paypal and get this over and done with ... It's too early in the morning so I'd be grateful if someone can alter the wording a bit :) ...

========

Hi, thanks for the latest pictures. I can't see any cracked keys on the keypad on either picture. The very first image you sent me had a picture of a silver/grey phone with a very badly cracked keypad, which you claimed to be my phone - comparing that image side by side with this picture you have taken , i can quite clearly see that the original picture (of a silver or grey phone) is quite clearly not of my phone.

I can quite clearly see that you have changed your mind about buying this phone. Despite me mentioning no refunds or returns on my auction I am very easy going and would be happy to give you a full refund , once you have returned the mobile, unaltered, along with box, manual and charger. If it turns out that I misrepresented the description of the phone in my auction you will get a refund on your postage too.

I can't be any fairer than that. Kindly please return the phone within the next 5 days and I will process the refund upon receipt and inspection of the phone. If you do not return the phone within the next 5 days I will assume you are happy with it and do not require a refund.

I also note with interest from your feedback that you have bought many faulty phones, including other D900's. From talking to some of these sellers its apparent that you have tried the 'small refund, but let me keep the phone' routine before. I am willing to overlook this fact so please return the phone so I can process the refund for you.

looks like 2 different phones to me

i would pop over to the mobile phone threads and redirect them to this one......in the hope there's an expert over there who knows these phones inside out EDIT: done this for you

middle bit (is it called the mouse?) is completely different imo, along with the 2 key pads at the side.
there is a clear difference in colour tone on the photo's - they cant be the same phone surely as that toning would be all over the phone if it was taken at a different angle and not at just set points. ifswim.

in your photos it is clear black colouring and no grey tones........................the guy's a ponka! i wish you the very best on this...........

• both the photos that he has taken of the phone are of the same phone , different angles and the flash do make a big difference to the out come of the picture . are they of the phone you sent ? i dont think so , even though your picture has no flash , is blurred and isnt as sharp as the ones he has taken , i can not see any cracks on the keypad.
were they the only photos you had taken, i take loads of photos but only select the best few to put on ebay,

saying all that i would not get into a debate about refunding some. its the phone back and refund.

i would email saying this then leave it at that .

I'm just going to reply to him giving him until Friday to return the phone. If he hasnt by then then i will assume he's happy with it. I will also mention that if the phone wasnt as described as in the auction he can have his postage back too.

I think this is really bending over backwards to make him happy and if he still resists then that will confirm he has other more sinister motives.

Only question is, should I correspond to him via a paypal dispute console or the My Ebay ? He has so far in all his emails has sent emails directly to my email, not via ebay,
