sold a phone on ebay - buyer having me on!!! EDIT: Now he's opened Paypal Dispute

Esclaate the claim to paypal and state that you've offered a refund upon return of the phone.
Paypal will ask him to return it by a trackable method, they will only refund it if he does this. The penny pincher doesn't sound like he would want to waste the £3 minimum it would cost to send it recorded.
If he does, then refund him, knowing happily that he didn't get a penny discount and you caused him to fork out a few quid and a trip to the post office. If he sends it normal post, then keep it, say you never received it (I wouldn't do this with any honest buyer because it is wrong ,but this guy deserves it) and he won't then get his refund.
You have to accept that he might send you the broken phone back, and then it comes down to your word versus his, never been in that situation, so I don't know the answer to that one. Whatever you do, don't give in and refund him, as this will just encourage him to rob others. Please can you pm me his seller id.
thanks for all the replies people. I am reluctant to post his seller account on here, because I dont really want people buying stuff from him then giving him negs , in case it jeopardises my chances of winning the paypal case.
If, as seems likely, paypal seem always to take the buyer's side, and i lose the case, then i will happpily post and you guys can go crazy .
In the meantime, I have the following evidence against him:
- message sent via ebays message system offering him a refund if he returns the item. He always replied via email directly, so it could be my word against his
- soon after i started this thread I got in touch with one of his previous victims. Exactly the same story - wanted a part refund and picked holes in the auction description. Seller got a negative, but bizzarely it was retracted by him. I dont know the full story why/how/what etc. I will find out.
- on Friday somone got in touch with me saying he has pulled a similar one with them, claimed screen smashed etc and they got an instant negative.
- i will spend a few moments getting in touch with others who have dealt with him to get more evidence.
- He has an ebay store, selling at least two Samsung D900's as 'working' for around £50 quid each .... presumably which he has built using phones which he has scammed me and others with.
- I refuse to talk to this user directly now as i know it will be a waste of time as i havent got anywhere before with him, and will simply escalate a claim against him on Paypal
- in my claim I will mention he has a sellers account selling working D900's. I can't really accuse him of anything more than that, but I can at least ask Paypal/ebay to investigate this user and his buying/selling history and provide with the evidence of my conversations with his other victims.
Phew, that took a while to type. Anyone think I am trying the right approach?? I dont know if its any good sending the photo's he sent claiming to be my phone to paypal?0 -
i have a version of the same phone at home,and under my zero at the bottom its all black,like the sellers,yet the buyers picture under the zero is 3 silver bars,so defiently a different phone
Same here, I have the model which the Op sold. The pic on the left, is not the same phone, as the phone on the right doesn't have silver bars across the bottom 'curve', and the phone/model I have doesn't.

A clear case of circumvension of Ebay fees...I have reported but only this one....would anyone else like to report the others....
