How do I prove my innocence when I have never parked on or near the alleged road, never received a ticket, and first thing I knew about the offence was when I received the Notice to Owner through the post? What eveidence can I submit to the appeals tribunal in my defence? Please help, I'm quite worried.0

Once you have made an informal appeal, the council will reply with their decision.
If the appeal is rejected, they will still allow you to pay the discounted fee or you wait for the Notice to Owner when you have the opportunity to appeal formally on the grounds that the contravention did not occur

I’ve been reading the parking discussion and success and failures threads over the past few weeks with a view to getting feedback on our article and seeing how MoneySavers are getting on with their appeals.
Whilst I want to thank those that are helping others by answering questions on our forum, can I please ask that you stop trying to drive (pun intended) MoneySavers away to the Pepipoo website, and this includes sending PMs to other users.
We appreciate that there are other forums available to discuss parking issues but if you want to discuss parking on MSE please do so on MSE, in order that we can help both existing and future MoneySavers wanting to appeal their parking tickets.

Whilst I fully understand your position it has only been done with the intention of getting the most experienced help to the posters, lots of parking problems can be complicated.
Naturally I'll abide by your wishes and refrain from referring in future.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -
i took my disabled sister shopping on friday and parked in a disabled bay which is surrounded by hatch markings. there was a large concrete pillar on the left hand side and i have a large people carrier. I parked at a very slight angle with my right rear wheel over into the hatch markings. i got a ticket for not being in the lines. i phoned to explain had i parked straight i wouldn't have been able to get my sister out of the car, i was told i should have reversed in but then i would've been unable to get my boot open to get my babies pushchair out. the lady on the phone said my car being in the hatchings may have prevented the person next to me opening their car door fully but we looked and couldn't see a problem. THe lady said i should think about getting a smaller car or parking better in the future! Do i have grounds for appeal? Apparantly there is 4 large signs saying that all cars should be parked in the lines but i've never seen one. Also i assumed the hatchings around a diasbled bay was to allow more room.0

I have been waiting for Martin to publish the Private Parking Tickets guide.
While that is under production, I need some urgent help right away please.
A couple of weeks back, I drove to Hounslow tube station around 9pm.
While parking my car opposite the station, I saw a recovery truck and the guys sitting in there. I thought it was a breakdown van and went into a shop. Didn't notice anything saying it was restricted parking...
I came back after 30min and as I was approaching the car, saw the recovery truck was still around. One of the guys came up and said my car was clamped and showed me a small sign with the warning on opposite wall. (Oh well, I see it now, but its too late.)
He then charged me £350 for removing the clamp :eek: including a surcharge for paying on my credit card.
I've now received the credit card bill and need to pay this amount.
I understand from reading around that I may be able to dispute this transaction with my credit card issuer.. (and thankfully, I paid by credit card).
Can anyone please help me with the credit card dispute? What do I call up and tell the card company? Does anyone have the legalese for the text of a written letter?
Has anyone successfully done this?
If yes, can you please share a template please? I have a Tesco Credit Card.
Any other info you can help with would be great.

First and foremost, was your ticket from a council officer or from a private parking company? This will make all the difference.0 -

As one of those who has been "guilty" of referring people to that other site which mustn't be mentioned, I would point out in my defence that I have also referred people from there to here, on topics related to general money saving, bank charges, etc.
I would also re-iterate two things that I have already said by email to the MSE site: i) the current advice regarding appealing Council tickets is incomplete - there are at least 2 other grounds for appeal in addition to the 9 already listed; ii) you are touting the forthcoming article on private parking tickets as "how to appeal", when in fact the best advice is never to pay them, never contact them, and most of all never get involved in their sham of a non-existent "appeals" process.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. Hi avis - was this a private parking firm (on private land) or when you say you parked opposite the tube station, was it on the road?
If a private company (which seems the case here) you can ask the credit card company to refund the transaction under Section 75 of the Consumer Credit Act. The private firm needs to prove that there was a contract that existed between you and them (also known as 'tort') and if the signage wasn't appropriate (you mention a small sign on the opposite wall) then it is up to them to prove there was a contract. The Road Traffic Act 1991 states that for a sign to be legal it must be cited within three car lengths. You should also mention that you paid 'under duress'.
