  • Sorry to hear of the fine, the normal advice on Pepipoo for a fixed penalty notice from the police would be to pay up, most unlikely that you would win in a maggies court. Whether you like it or not the BIB's opinion weighs very heavily when something like obstruction is involved.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

UH just got a parking ticket from Norwich CC. He paid and displayed enough for all day parking, so the ticket (from the machine) displayed 05:00 the next day as the time he could remain til. He had displayed ticket correctly.

Got back to his car about 5.30 pm that day and found a ticket for failing to display or not having a valid parking ticket.

No reason for this. He's appealed by email with a scan of the ticket. If he pays within 14 days the penalty is half price. What happens if he doesn't hear for 14 days?

Once you have made an informal appeal, the council will reply with their decision.
If the appeal is rejected, they will still allow you to pay the discounted fee or you wait for the Notice to Owner when you have the opportunity to appeal formally on the grounds that the contravention did not occur
  • I have today received another letter from the private company excel and

This is all part of their scare tactics. Do nothing.

IF they took you to court (about 1 in 1000 chance), and if they won the claim (extremely unlikely if properly defended), and if you lost and didn't pay the judgement within 28 days, then and only then could bailiffs get involved.

You're much more likely to be served by Elvis at your local chip shop, especially as you paid for the parking anyway and their losses = £0.00

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    Unusual parking ticket
I received a parking ticket for actually parking my car adjacent to a dropped footway. My car was parked next to someones driveway, well a driveway never used as teh garage door probably never been used for years, however I wasn't blocking the driveway, but my car was parked adjacent to a dropped footway, so its like I am using very tiny amount of the driveway to park my car.
I really dont know if I should appeal for this and if I would win, please someone help?
You need more expert help from a site dedicated to helping motorists. Pepipoo.com. They have legal people who can put you in the right direction.

  • I am hoping to get advice after having beeing wheel clamped on a private car park and having two babies with me at the time, paid £90 on the spot in order to be able to move the car and take them home.

I had used the car park many times before for Blockbuster and Maplins on the premises and just didn't look at the admitedly clearly marked warning signs on the day that I parked up and walked over the road to another shop for half an hour.

So, its a fair cop. What I am absolutely furious about is that fact that they can seemingly charge £90 which is so much more than a standard speeding fine or even a normal parking fine. Has anyone ever contested whether it is a 'reasonable' amount in the courts, or can they just do what they want on private land? If this is the case why don't they just make is £1,000 a time since they are obviously out to just make money?
  • They do because they can. There's nothing to say you can't try to charge £1000, £10,000, whether anyone would pay is another matter. Whilst I think that £90 is a lot of money, the London councils often charge a lot more. you may have redress from your C/C company if that's how you paid by doing a chargeback as you were under duress, 2 children etc.

If it was a dropped footway (to allow pedestrian access on to the pavement - there would be a similar one opposite), then they could have a case - but you would still need to check out the validity of the ticket, etc on pepipoo.

If it's for a driveway, then you are actually allowed to park over these if the homeowner doesn't object. Can you imagine if they ticketed people for parking over their own drives?! What a farce that would be.

Get on to the parking forum at https://www.pepipoo.com for some further info.
  • I remember seeing a post on Pepipoo where someone got a ticket for parking over a dropped kerb and it was their own. It was however a shared drive so got complicated. Don't remember how it turned out.
