  • Thank you so much for this thread! A couple of weeks ago I received an Enforcement Notice from Civil Enforcement Limited (for no reason apart from visiting a car park for 10 minutes, once at 12.00 and once at 16.30 -the car park has 2 hours free parking) and you'll be pleased to hear after reading this I've ignored it. I've just received a 'final reminder before legal action' Notice and I'm ignoring that as well. I'm getting in touch with my local MP too as the car park is used by a lot of elderly people and feel that action should be taken with regard to these notices.

    Another update. Just received a letter from Newlyn and the total now is £240, and telling me not to ignore this letter.Starting to get a bit rattled now but am willing to stand my ground as othershave done. Will keep you posted.

    A quick update. My daughter received a 'Final reminder before legal action' letter this morning from Civil Enforcement, quoting 'Failure to pay full amount within seven day will result in immediate County Court Summons against you ...........your ability to obtain credit in the future could be affected', does she still ignore it?

    Remember that post. CEL gave you 7 days to pay or an immediate county court summons would be issued.
    That was a month ago!!! What's keeping them.?

    No summons and they pass it to Newlyn?

    Keep strong it will soon be over.

    I overstayed my 2 hours at the local co op and received a demand from these guys for £90 or £45 if I paid in 2 weeks.

    Fair cop, I paid on their automated phone payment number 2 days later, £45 on my credit card. accepted, but no reference neumber given (hmmm...)

    Today - a demand for £90 because I have not paid. Checked credit card account - not debited.

    Got their cutomer service number (' call to discuss parking issues ...') - it was the automated payments line, not a sniff of a customer service agent.

    Dodgy ain't the word for it.

    Fair cop?! You tried to pay a PPC scam fake PCN and you think it was a fair cop?

    Start ignoring them, as you should have done. Thank goodness the payment was not taken.

    To be honest |I thought so at the time, yes - the car park said there was a 2 hour limit and I knew I had overstayed.

    are we saying that Civil Enforcement are not entitled to fine me? To be honest I don't quite get it, since the advice given by tradingstandards.gov.uk about parking on private land includes:

    ...There are 2 aspects to the Parking Charge Notice method of preventing/minimising unauthorised parking. Firstly the deterrent effect, with exactly the same methodology associated with Clamping. Secondly the use of demands for payments with incremental steps to obtain payment. In principle there is nothing wrong, subject to being appropriately warned, with a demand for payment for parking where the vehicle has:
    • Exceeded the stipulated time or
    • Where payment has not been made or
    • Where parking on private land.

    We are saying that Civil Enforcement are not entitled to fine anyone. See my signature for what Martin Lewis says about PPCs (private parking companies). No person or company can fine another, it's not lawful and would be unenforceable in Court (not that these companies do Court, they just do threats and CE are typical and well-known).

    Trading standards are not wrong in that 'there's nothing wrong' with any firm invoicing a person for any service or product they reckon they have provided. It's not illegal to say someone owes you money, I could say you owe me money for this reply, but it wouldn't (couldn't) be a fine and you wouldn't have to pay me!

    But the flip side to that TS advice is that there's nothing wrong with a person ignoring a fake PCN (for that's what this is) either. You must not pay, whatever the circumstances, nor appeal, nor contact them at all. This was not a fair cop, they have no authority to issue penalties at all, this was not an offence and there is NO FINE.

    It IS a scam. Read the sticky threads at the top of this forum; 'PPC letters, what to expect' so you know about the debt collector 'scary-letter-chain'. And look at the info on 'Welcome, please read before posting', especially the Watchdog solicitor advice linked there:
