    A quick update. My daughter received a 'Final reminder before legal action' letter this morning from Civil Enforcement, quoting 'Failure to pay full amount within seven day will result in immediate County Court Summons against you ...........your ability to obtain credit in the future could be affected', does she still ignore it?

    Absolutely ignore ..if you are unlucky enough to be the 1 in a million that gets a County Court Claim don't ignore that get over to :-

    they will be able to give you best advice.

    However the chances of Court papers are a million to one or less.

    Remember the upfront costs are paid by the Claimant ..so it's not really worth their while on a case which they may well lose ..it's easier and better business to just move onto the next victim who may be intimidated into paying.

    PS That line about affecting your credit is a blatant lie ..the issuing of a County Court Claim does not affect your credit rating..that will only happen if they pursue their claim into court (snowball in hells chance) ,they win (almost unheard of) AND you then don't pay up within 28 days of the judgement ...not going to happen is it ..more chance of winning the lottery twice !

    Do you even have County Courts in Scotland? Aren't they Sherriff's Courts?

    Typical PPC computerised template letter bearing no relation to reality, ignore the thratogram obviously! :T

    Fake PCNs are still fake PCNs in Scotland too, still unenforceable.

    I have just recieved a PCN for the same car park. I was waiting for my housemate to finish work and hadnt realised I had to pay to sit and wait in my car! I arrived at 18.00.55 and left at 18.11.23 and they want £75 (rising to £150) for over staying the free 10 minutes! This company is a joke.

    After reading this thread I will ignore their letters and sit it out. I work in the parking industry and know that these aren't enforceable, however thoughts towards it change when you are the one that gets the "fine"!

    Has anyone actually had bailiffs turn up or been taken to court? I'm guessing my 20 second overstay would be laughed out the court if it ever came to that!

    You have got that the wrong way round. For a (proper) bailiff to "turn up" the case first has to go to court (very unlikely), you lose (very, very unlikely) and then you don't pay whatever the judge orders within 28 days.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    Yes you can ignore 'em in Scotland too (voice of experience!). Bear in mind that after they send you all the pretty coloured letters from them and their sidekicks Newlyn (almost identical letters by the way), it would cost them a minimum of £65 to take you to Small Claims Court to pursue a £75 payment. No chance! They'll move on and concentrate on the poor suckers who DID fall for it.

    A bailiff usually needs a Warrant signed a judge/ magistrate. Plus is it a geniune debt?

    The 'contract' is a very wishy washy one at best. I.E there was a sign - how do they know you didn't see the signs? What if there was a van or lorry or cars or even trees etc blocking the view!?! How do they even know you can read?? They are assuming that people don't have learning difficulties, don't sight problems, all speak English and can read it as a first language and how big was the print on the sign?? Was it suitable for the visually impaired or vertically challenged?? The 'CONTRACT' is one based upon 'ASSUMPTION' (and we all know what that is!)

    Even verbal contracts don't have much clout, the only contracts with a bit of can often require a third party witness. Who bases a contract on assumption??? Come on!

    Plus was it reasonable to issue the Penalty? (was there an obstruction? can they evidnece lose money? etc). Can they evidence you didn't buy a ticket? My mum got one years ago in Northampton in a pay and display after the P&D ticket slipped down the dashboard and bottom of the windsreen (this has happened to me with permits etc, I am regulary having to fish my tax disc out of this area!?

    I recently got a PCN in the post saying my car was parked ''illegally'' in Asda at 4pm - it doesn't specify when I went in or out! No mention of any photo/cctv evidence either). What a bunch of chancers! Maybe it was one of the many days where I didn't have change so went into get some etc?? Or maybe one of the occasions where my ticket had slipped down or I'd left it on the seat?!? How can I remember when I am in there so often!? Unfortunately I throw the spent tickets away. Plus I think I may have had my visitors pass then which they may or may have not seen. I am just intending to IGNORE all correspondance off them.

    Basically back to the point (as I have digressed). If they come to the door do not open or give them your details. If things get ugly - call the Police and also threaten to call the police because a lot of these 'debt collectors/ bailiffes' are just chancers. Court approved bailiffes deal with local authority matters and bankruptcies etc. They are way too busy to help the poor PPC's get their money back off those nasty 'illegal' parkers!

    Do call the Police everytime any so called bailiff shows up.

    They will be useful in evidence for when you take these criminals to court.

    And did you know the Police will often remove these jokers wheelclamps too.
