Hi folks, new member to this forum.
I too have been getting letters and hassle from Newlyn/Civil Enforcement Ltd, regarding a supposed parking infraction in Irvine in Dec of last year.
Yesterday, I received the latest: 'Notice Prior to County Court Proceedings', which tells me that I 'may now be registered in the County Court', and that 'bailiffs will be allowed to remove household effects and cars' etc etc etc. Needless to say, thanks to common sense and the excellent advice given here, I have been ignoring every letter.
Correct me if I am wrong, but as an English company, Newlyn/CE Ltd have no legal authority here in Scotland anyway, dont they?....
Would be interested in the thoughts of others here, esp other Scots who have been victim to this nonsense.0 -
Note the word "may". As you see, these clowns have no idea of the differences between English and Scottish law.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

I received one of these Parking Contravention Enforcement Notices today from CEL and thanks to the advice given here and on PePiPoo I'll be ignoring it. However, whilst several members here have pointed out that these notices are NOT legally enforceable, I haven't seen anybody detail exactly HOW and WHY they're unenforceable.
In regard to the notice itself, importantly it contains no Company Registration Number or Registered Head Office details, so the lack of those alone justifies a reason to ignore it completely.
I was driving my partner's car so the notice was sent him/her as the registered keeper - I won't give too much away, you never know who's looking in.0 -
I have received a new letter from Newlyn stating that:
'our clients will proceed with alternative collection activities including registration of the charge in the County Court, this could result in Certified Balliffs being appointed who may remove goods for sale by Public Auction'.
Any thoughts on this and where it and I should go next?.0 -

I received one of these letters today too. It was pretty shocking at first as my eyes just jumped to the £150 'total amount now due' section. It has my car reg, make and model so I took it seriously at first. On closer inspection though I knew it didn't seem right and then a search on the net resulted in lots of good advice to ignore. Its very reassuring to read other people's opinion as I at first was wondering where the heck £150 was going to come from.
My letter says its a reminder and I have not received anything about a parking offence prior to this. It has no details of where I was supposed to have committed this offence, only an 'incident date'. There is no details of who they are supposed to be acting on behalf of. This is why I thought it was fishy - just a claim for £150 in the post which I am supposed to pay!
I read that this company were meant to be getting investigated by Trading Standards so its clear that CEL are not being shut down and are still being allowed to operate. That's ridiculous.
I am a little nervous as I know I will be receiving more threatening letters in the coming weeks. No matter how unenforcable they are its still upsetting. Need to brace myself.

Registration of the charge in the County Court? What are they on about? These people need reporting.0
