checked again this morning, no money refunded again.
cant wait for the letter to arrive to say you have not paid this month! cos i sure as hell aint payin any more till i get my cash back, and would also like interest too, as i have intrest paying current i have lost out. will be issuing a default letter to them i think and standard charges on it too!!! lol:rotfl:self confessed 80's throwback:D

I sent them an epic (3 page) letter to both the address they gave me over the phone and also their head office on Friday, they should receive it today. I told them I was charging them interest at their cash advance rate of 21.33% pa, as I not only paid the full amount but also the minimum payment (£54.44) to make sure I didn't default. I also told them that if they didn't acknowledge receipt of the letter by phone as soon as it arrives then my solicitor would be contacting them.
Will keep you updated as to what response (if any) I get!0 -
I've just done a quick estimate of the charges (this is Capital One's charges):
3% cash advance fee.
£12.00 late payment fee
Cash Advance rate = 21.33% AER.
I'm looking for the above as compensation, with three late payment fees (the three promised/guaranteed deadlines missed).0 -
I have the same. My partner used my card to pay, and I got done 17 times. They have £2500 of my money now for over 2 weeks. They keep saying it will go in, I was told last Monday, then Wednesday, Then Friday, and finally again today. I cannot pay any bills, my council tax, electricity, gas etc. I have sent letters to Capital One, the Finical Ombudsman but no reply. I am now furious, but can't speak to anyone. My bank say it is not fraud because i gave them my details. I really don;t know who to turn to now! I m being charged loads by my bank, and have the people I owe on my back to! If I had enough money to pay off Capital One I would, and never come back!0

If I were you I would try to keep all charges in one place, if you can arrange for an over draft extension. If this is not possible take cash advances on your credit card.
I know you shouldn't have to do this, but if this ends up going to court (which I am prepared to do) you will have to show you are being reasonable. It could be quite a mess if you have to deal with lots of different companies.
However you MUST write down every single thing you did. Every phone call, fax and get the names of the people you spoke with (including date and approx time).
The financial ombudsman will only get involved after 8 weeks. Clearly we all want this settled well before then.0 -
After getting this (1) last week I sent another message as I hadn't received any refunds to my bank account . I got the other reply(2) this morning ..A lot of help that is .
(1) "Thank you for contacting us about the payments of £21.23 which have been taken from your bank account. I can confirm that we've already arranged to send these payments back to your bank account. You'll receive a separate letter confirming this. Please note that we will also be sending a letter to you by next week about refunding any incorrectly charged fees or interest if added, amending credit files where appropriate, and bringing current minimum payments to zero if the payment due date has not yet passed. I'm sorry for any inconvenience that we've caused you. If you need any other help please call us on "
(2) "Thank you for contacting us about our previous messages about multiple debit card payments. Please accept our apologies for any inconvenience or confusion we've caused. I'd like to reassure you that it's not our intention to cause you any more problems. I've passed your message onto our relevant department and they'll reply to you by letter within the next two weeks. I'm sorry that I can't give you an immediate answer. "0 -

i feel so much for all of you who have paid loads and are now in difficulty through this, im in no way compromised with my issue its only about 35 quid 2 x minimum payments, but it still makes me angry if it meant i could guarantee you all got your money back i would totally forfeit mine in payment for that.
i really think they need to be investigated, surely its just a click of a return button to return it to our accounts, something just doesnt ring true with this fiasco now, i cant imagine any other organisation acting like this they simply dont even reply to complaints not even written formal ones, it appears there is no rush on thier end, obviously they are making a fair bit in interest. we only know of us its happened to but i bet there are hundreds who dont know about MSE who have had this prob.

I wrote to Captial One on 15th September asking for £529.41 worth of charges to be repaid, using a template supplied by MSE. When Capital One wrote back they pointed out that I had signed terms and conditions for my card that included their right to charge me at those rates.
However they understood that £12 had been deemed a much more reasonable charge than the £35 or so they were charging me previously, so offered to pay me the difference, which totalled £120 (which I thought was rather pathetic).
They also sent me a declaration form that they wanted me to sign, agreeing to accept £120 as a final settlement, ensuring that I would never chase them again for default charges. Of course, I wouldn't stand for that. I wrote back saying that this was not satisfactory and that I would only settle with no less than £500.
Clearly this irritated Capital One - their next letter was much harsher in tone and they stuck to their original offer of £120, enclosing the same form for signature as before.
It doesn't look like they're prepared to change their minds. I am in financial hardship so I would naturally prefer to speed things up by filing it as a small claim but on the other hand, I'm not sure exactly what fees altogether that I have to pay?? Has anyone had the same experience with Capital One?0 -
