    Print off everything that buyer/seller writes about you and then kick his !!!!! Let him get on with it for a few weeks, let hem cancel and him relist and then you'll have more proof with more auction numbers, print out's etc... print off everything though, several times, and get in touch with a solicitor!!

    Explains all about how to take him to court for damages. I personally can see that you have a claim against him, especially as eBay see fit to reove the listings too.

    I would start by sending him a letter quoting the appropriate act and tell him that if he does not cease immediately you will be seeking legal advice with a view to suing him for damages. Make sure he has the letter and send it Special Delivery, if you can get it sent via a solicitor more the better. But, make sure you keep on top of the listings and print everything off. Check your caches from today and see if you have more you can print off that have already been cancelled, then put those item numbers into eBay for proof that eBay removed them for breaking violations. What he is doing against you is illegal, if he refuses to stop then sue him.

    Sorry for all of the reading I've now subjected you too. Look for 'Malicious Falsehood' on Google as it seems that this is what it comes under if someone is making false claims against your business.

    I've googled and what he is doing, you can sue him for Malicious Falsehood - that'll stop him laughing when he gets a summons!!

    no i'm not a member of a union. whys that?

    i've just read about malicious falsehood, trouble is i don't know if he genuinely believes the item is counterfeit or if he is deliberately lying and actually knows they are genuine.

    it seems to me that he actually thinks they are counterfeit, despite me telling him i was happy for it to go to a paypal dispute, happy for it to be inspected by the manufacturer if necessary and happy for ebay, paypal, trading standards, police etc to get involved if necessary as i had no concerns as i have invoice to prove my supplier, and proof they are an authorised reseller.

    did he really think i would say and do all that if i didn't think they were genuine? :confused:

    pinkgem, don't you have supplier invoices? If so then you have a supplier, the invoice should say what you are selling to prove in court that the goods you are selling are not counterfiet.

    Can you pm me with your ID and an item number of what he is selling and I will have a look tonight/tomorrow when the kids are out from under my feet.

    It does not matter that he thinks they are counterfiet - they are not and it is this claim that is damaging your business.

    If you are in a union you can get free solicitor help for stuff like this. It was a long shot but hubby is still in the union from his old job 4 years ago as he knows he can get legal representation for nothing so I thought I would ask. Have you checked to see if your business account covers you. Who are you with?? Do you have a merchant account, house insurance (if they know you work from home) business insurance, anything that will give free legal assistance for this. PM me if you prefer.

    The other point is that short of him wanting his money back he has made no effort to return the goods to you for a refund/exchange/examination.

    He sounds a bit of a loser, thought he was going to get some free stuff and you fought back so he thinks he is being clever. It is time for you to get clever though and make sure he knows that there are repercussions for what he is doing. At the end of the day, if it came before a court (all of the costs, fees, etc... will be a business expense) then you would be free to show your invoice to the judge.

    While I think of it, pring off everything from Paypal too. Paypal gave him time to respond and he failed to do that too so his concern could not have been that great!

    You can stop this but you have to be prepared to fight it. x

    yes i have invoices from the supplier, and the supplier is listed on the manufacturers website as being an authorised reseller. i uploaded the invoice and a screen shot from the manufacturers website showing their retailer list, to the paypal dispute.

    to be honest i don't want to get a solicitor involved, or talk about suing or anything like that as it just seems a bit ott.

    i'm only a small business seller and i only have about 20 of the items left, and can't get hold of anymore at the moment. they are a fairly slow seller anyway, so i couldn't say for definite if i have suffered a financial loss or not

    oh i've not mentioned his excuse for not being able to prove they were counterfeit have i? according to one of the answers he gave to a question he asked himself on the listing, he was in a car accident a couple of weeks ago and is unable to do much from his sick bed...

    although i'm not sure how he has been managing to constantly sell items on ebay and get to the post office for the last few weeks from his sick bed - but not able to get to a high street retailer of the item to ask for proof they are counterfeit.

    also the original couple of listings had my picture and my ebay id in them, and i don't have any copies of that now... checks... actually i did do one screen print and saved the listing of the 2nd one.

    there was one where he gave my name in the questions and answers that he was asking himself. i don't have a copy of that.

    but the more recent ones he has just stated the price i am selling them for in one of them - which make it obvious they are mine but not in such a way that he could get in trouble for it. there is a question on this one where he boasts that every viewing of his listing is a potential sale lost for me!

    and then there's the other listing where his new id is my name then ebay scam after it.
