    pretty good going.

    I've got just 6 bottles and so far £24 charge less £5 delivery credit. Just rang again and they are refunding me £17. :xmassmile

    We wrote to Terry Leahy as we didn't think we were getting the wine as like many others it was cancelled online. However, after posted letter on the day wine was due to arrive it did arrive :confused: . We were only charged £5 delivery charge as credit card used wouldn't go through (local store phoned to tell us this). Gave debit card number but only debited £5 :confused:

    Anyway got reply today with £15 moneycard attached. So originally wine cost use 42 p per bottle and now they are paying us for it :beer:

    Hope this helps someone as worth a stamp to complain :rudolf:

    I still haven't had my refund as promised in the email of 2nd December despite 3 phone calls and 3 emails. The last email has completely thrown me as I sent the chap the order number (and screen shot showing delivery made etc) and I got this response as if no order had been despatched:
    I would like to advise that any order placed on our website, is simply an offer from a customer to buy goods from us. No actual contract exists until the goods are despatched.

    Therefore, we are not obliged to accept such an offer until this time, and can decline to supply these goods without necessarily providing a reason.

    However, as soon as the goods leave the warehouse to be sent to the customer, a contract is created, and we are then entitled to charge for the order.

    I trust this has clarified the matter for you.

    ~so I sent another email:

    Sorry but can you ring me as I don't know what you are talking about xxxxxxxxxx. I am fully aware of my rights under the Distance selling regulations as to when a contract takes place. You have despatched the goods. I accepted delivery but noted on delivery note that you only delivered 6 bottles. However your email had addressed this so I accepted the 6 and awaited the refund as promised. You have not refunded. You have overcharged me for the goods. You have sent an email saying you will refund the money. As your despatch of the goods indicated your acceptance of the contract i.e. my order you are now in breach of that contract. Under contract law I am entitled to either sue for specific performance or to accept compensation for the shortfall in your execution of the contract. I have been more than agreeable to accepting the compensation. i.e paying 1/2 the price because I only had 1/2 the order. Tesco however seem incapable of carrying out their half of the contract.

    Here is the email (dated 2nd December 2005) advising that you would refund the money:

    So am now constructing a letter of complaint as they seem to ignore you when you ring up!!!!icon9.gif

    i refused my delivery when it turned up, "buy at full price phone up we'll give you a refund etc"............ So i checked my accunt they have deducted the full amount, refunded it minus the £5 delivery charge!!!

    So 3 phonecalls, and emails all telling me i will get my refund and 2 weeks later nothing!

    If you do write this letter can i take a look, as i will most likely do the same.
