tesco.com, Wines of the Loire mixed case quantity mistake [CLOSED]

I sent an email asking for the cheif executive's email address and got this reply.......................
Dear Customer,
You have recently ordered a 'Wines of the Loire Mixed Case'
from Tesco.com.
Unfortunately there was an error on the website stating that
the case consisted of 12 bottles when it is in fact made up
of 6 bottles.
We understand that you may be disappointed to receive the
case of 6 at the price of 24.00 GBP which you have paid for,
so we are in the process of refunding half of the value
of the case you have ordered - 12.00 GBP - back to your
account.
Regrettably we are not able to supply further cases as it
is a limited edition case of which further stock is not
available.
If this is unsatisfactory you are still able to return the
wine for a full refund. Should you wish to do this or if
you have any further questions, please call 08457 225533.
We apologise for any inconvenience caused.

received same email re half price & 6 bottles only, despite no wine delivered. weird, but a bit of hope there to get this order honoured. but.....my delivery date has passed.
legally, not sure where we stand, as they have get out clause on their t&c's. so it would really be just an honourable thing to do by them if orders fulfilled.

The prices payable for the wine that you order are clearly set out in the web site. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item concerned...................
2. Availability
If for any reason beyond our reasonable control, we are unable to supply a particular wine, we will notify you as soon as possible. Vintage wines are obviously limited in availability. Whilst we make every effort to ensure that the advertised vintage is the one that we deliver, we cannot guarantee which vintage will be shipped to you....................
3. Acceptance
There will be no contract of any kind between you and us unless and until we actually dispatch the goods to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us, and you will be charged for the goods..................0 -
I've just phoned the number on the email and spoke to the wine section. They didn't know about this email, confirmed my order existed only as a cancellation and didn't know what to advise. Then she suggested I hang on for five days and my local branch should contact me to organise a delivery date. She did not sound confident that this would happen and gave me the local store's telephone number to ring in a couple of days if I haven't heard anything. The left hand does not know what the right hand is doing. I'm loathe to order again without knowing what's going on.0

Our local branch contacted us yesterday to say wine would be delivered after all yesterday afternoon after rechecking card details. Nothing came!
So rang local branch who now say its out of stock. Home shopping manager knew nothing of the phone call and has sent me back to wine warehouse - where of course we all know its out of stock!! Confused....0 -
Its only out of stock in cases of 12 (as they never existed)
They still have stock on cases of 6 if this helps anyone argue their case!0 -
I sent an email yesterday evening playing dumb to CS saying my wine hadn't been delivered as arranged. Today I then received an email offering the 6 bottles for £12 saying I must be disappointed with my 6. I rang Tesco wine to say I hadn't had anything delivered. He apologised and has re-arranged delivery for next week. I asked him to confirm how much I would be charged i.e. £12 and he said to ring him after delivery and he would ensure that's all I paid. He would also refund the delivery charge. That's nice of him seen as I used a free code! He has now sent me a new order confirmation for 12 bottles for £24 with a new order number.
Wonder what, if anything, I will get.
No money taken from my bank account yet.~Laugh and the world laughs with you, weep and you weep alone.~:)

I'm so pleased some of you are getting a result (well some sort of result!) from this
Mine's still cancelled and I've not had any emails offering me anything else - boo hiss to Tesco.0
