Hi
The company did not lose lot of money on court cases. The shareholders never had intention of paying anyone. The shareholders paid themselves £260000/- for given year although they were not honouring the cashbacks. If you check online, the liquidation costs not more than £3000/- and owner can appoint his own liquidator. No one is verifying shareholders claim that they have no money not even the liquidators. The liquidators are documenting what directors tell. And none of us will challenge shareholders or liquidators as all of us do not want to lose any further money. The director has listed himself as creditors and major claim on the it. So any monies P2UD makes over coming months would probably go to Director. As for other creditors, they may just be dummy companies owned by directors or his relatives, thus all planned to route money back to his own coffers. Its sorry to see that law cannot help us as everything is as per rule book. It has been good learning exercise for all of us. Whenever, you start losing money book your loses and move away. I too filled a MCOL and had to pay £55/-. Its all gone now.
On aside from the whole class action thing, which I missed due to being away, the above is interesting. £26,000 is not much at all over the year, not that I want to defend these people, but from what I read there are at least 2 directors. Quite honestly, if my household income was only £26,000, I'd be homeless within 6 months (I can see a lot of people hoping...).
Don't get me wrong, I'm not sympathetic, I lost out on 2 contracts, but I kind of take Mobile Junkie's view on these things. On the other hand the only way that the director can be listed as a creditor on the account is if the company owed him money, full stop. This means either that he put his own money into the company (in which case guys, we have the last laugh as he's obviously lost a lot more than us), or he has not been drawing some of his dividends to keep money in the company (same thing really).
Either way the only winners here are the networks, they still have their jobs and earn from our contracts.0 -
You missed something in your defence of the £26,000.
A nought!
The figure quoted was £260,000!0 -
Hi all,
I have just found and registered on here after the problems that I have had with this particular company.
And I think that I know the answer to this but as I am coming (thank god) to the end of my contract do you think that I have any chance of my 3rd and final cash back claim ?.
My first was turned down. (possible a mistake on my behalf of registering for online billing which has now been changed back to paper bills)
I am still waiting for my second claim. (sent January 16th)
BOTH OF THE ABOVE I SENT REGISTERED POST. (I had a feeling ;-(
Regards

Hi guys,
its me again. After sucessfully recieving £230 after winning the court case, I have again recieved the judgement in my favour for second and third claims.
I know the company is busted so I m thinking what can be the best option to get the money........... any opinion are appreciated!!!
can the service provider help!! or p2ud themselves if they have a pool of money 4 us!!!

There is no possibility of enforcing the judgement.
All you can do is join the creditors and register with the liquidator as one in the hope there will eventually be a payout to creditors.0 -
Thanks Quentine,
Is it possible to join the creditors list without issuing a warrent?? Not sure how this will work.....
Thanks,
Rushabh0 -
Contact the liquidators, they will send you a form to register as a creditor.
All creditors can register (you don't need to have a ccj against them).
But don't get too hopeful on getting any money.0 -
:rotfl:And not forgetting that this was just the dividend payment (=tax dodge). They also paid themselves a salary of 60k so I think we can put those violins away now...
Fair enough, I wasn't trying to defend them, as I said I've lost out too. My violin is currently being ebay'd to cover my bills.
Goes to show that it's easy to draw the wrong conclusion from this forum if you don't do your own research.0
