Any fees paid to MCOL are non-refundable once the applications they covered have been actioned.

I know it's unlikely to help anyone get money back, but I have been corresponding with Mr David Elliott of Moore Stevens, regarding the creditor situation. Although we had a summons issued against P2UD, we were not included on the creditors list provided to him. Having queried the status with him, he is of the opinion that once judgement is entered against P2UD then I will become a creditor of the company - simply being owed money by them may not be enough.
I must admit that I was tempted just to drop the whole thing, but figured that as I had paid for the Court Process I may as well complete it, and it would now seem that this is the only way to get on the creditors list anyway.
The daft thing is that taking into account the fact that we managed to get one payment of of the slimeball, our deal cost us a figure that we would have been reasonably happy with anyway, but things like this damage the trust I have in people - nest time a company is late with anything owing to me it may find a Summons arriving pretty quickly - we gave him too many chances....

Has anyone thought about the possibility of suing the administrators? (David and Angela Ellis)
I've read somewhere that if the administrators of a company continue trading on the know that their company is insolvent and will not be able to pay its creditors, they are personally liable with their own assets.0 -

Phones2udirect is the latest online retailer to be added to the ever expanding list of dying cashback dealers.
Accountants yesterday began liquidating the Kent-based company, which at its peak connected between 500 and 800 customers a month, before it moved to affiliate only sales in November last year.
Accountant David Elliot of Moore Stephens said the exact amount owed to customers would not be know until his company had received all of the outstanding cashback claims.
He said: ‘There is a pot of money but I don’t think it’s going to amount to a huge amount per person, but it’s too early to hazard a guess.
‘It’s going to be at least 18-months before any money – if any – comes back to people, because we’ve got to wait for people to claim.’
For the last four months, Phones2udirect’s website has re-directed customers to sites such as e2save, Mobiles2yourdoor, Phones4u as well as Vodafone and O2.
Speaking to Mobile in December, Phones2udirect boss David Ellis said the move to affiliates was due to ‘a change in the market conditions.’
Elliot added that a message informing customers of the plight of the business would be placed on the Phones2udirect website in the next seven days.0 -
Been on the cards since dextra withdrew their fulfillment contract. I have just entered the claim window for claim 1, was hoping they would last long enough for me to claim and then mcol them for the full amount when they failed to pay within 45 days but not to be. So much for spreading my risk using different companies, now lost 600 with CNM/PBD and 500 with this bunch - I'd better contact t-mobile and see if I can get a fiver off per month line rental and cancel the webnwalk.I think....0

When I asked David Elliott of Moore Stevens about creditor status this was what I got back:
We have not been provided with your contact details and so the attached notice to creditors was not sent to you
I think that if you were on the list of creditors supplied to Moore Stevens you would have received the notice to creditors advising them of yesterdays meeting.

Hi, now that they have removed the Ts&Cs from their website can anyone tell me the address to send the cashback claims into. If someone downloaded all the Ts&Cs that would be really useful. I have read about the "pot of money" available for cashbacks but I'm not holding my breath. Sounds like it could be a while.
I am on a 42.50pm contract which is way more than I want to be paying assuming the cashback will be minimal to none. Has anyone had any luck downgrading a contract with T-mobile? Since T-Mobile were allowing P2UD to market their phones do they have any sort of liability here?0 -

On the off chance that there is some money left after the administrators take their fees, there is likely to be other protected creditors who need to be paid first. There's also going to be plenty of people who have already claimed and subsequently gone down the MCOL route and have requested judgement by default, therefore will be in line for payment before anyone who is due to claim. My advise would be to forget about claiming as you'll just end up wasting time and money.
What you would be best doing is to contact T-mobile and downgrade the tariff to a £15 or £20 per month. The network won't be accountable for the cashback as it isn't there deal therefore not responsible.0
