You weren't to know. I'd have done the same in your position. Your only mistake was buying a contract from them in the first place - not in trying to enforce your rights under it.0

You are right, mobile junkie.
There was never going to be enough money for all those owed, but because so many people took action through the courts, this company was finally put out of business before they could cause even more trouble.0 -

The company did not lose lot of money on court cases. The shareholders never had intention of paying anyone. The shareholders paid themselves £260000/- for given year although they were not honouring the cashbacks. If you check online, the liquidation costs not more than £3000/- and owner can appoint his own liquidator. No one is verifying shareholders claim that they have no money not even the liquidators. The liquidators are documenting what directors tell. And none of us will challenge shareholders or liquidators as all of us do not want to lose any further money. The director has listed himself as creditors and major claim on the it. So any monies P2UD makes over coming months would probably go to Director. As for other creditors, they may just be dummy companies owned by directors or his relatives, thus all planned to route money back to his own coffers. Its sorry to see that law cannot help us as everything is as per rule book. It has been good learning exercise for all of us. Whenever, you start losing money book your loses and move away. I too filled a MCOL and had to pay £55/-. Its all gone now.0 -

There have been a number of posts removed relating to MSE users starting a group class action against this company.
This has been referred to the Forum Team for them to look at but please be aware that MSE is a private site owned by Martin and therefore he is legally responsible for any posts on MSE. From a post by Martin....

That's the point; you say something offensive, contentious, libellous and if it's not deleted I'm in Court. That's why my abuse team are there to protect me. I choose my fights carefully versus the banks when necessary or big companies. I prefer not to have my fights chosen in the forum without my presence.
What has been posted is not offensive etc but by using MSE as a platform for a group class action then this may well involve Martin in any legal proceedings.
For these reasons I'm sure you will understand why these posts have been deleted and referred to the Forum Team. Please don't post further about this meantime.0 -
I'm not sure what you mean by it being unfair of Martin, I removed the posts on legal grounds as posted above and have referred it to the Forum Team for them to review and if necessary they will run it past the lawyers.

I'm not aware that Martin has personally named the company; it doesn't appear at all in a search on the main site, only the forum.
Allowing people on a forum to discuss phone company offers doesn't constitute personal endorsement of those offers.0 -
Quite unfair of Martin, considering that he was the one who got us in this mess in the first place.

The least that he could do now is offer some support to those trying to do something about it and not just deny any responsibility and remove their posts.

:rotfl:Martin made me do it. You're a grown adult, and entered into a contract of your own free will. Enough posts have been made on this forum relating to schemes like this collapsing, and the fact you may receive nothing.
The cashback should only be seen as a possible credit, and you shouldn't go into a long-term contract at £xx a month if you can't afford it, and are just relying on a possible cashback to fund the contract.0 -

That was killed off years ago in this country. For instance s.1(2) of the Defamation Act 1996 states a moderator can be held legally responsible for any defamatory posts on a forum, due to the fact they have some element of control in publishing a post ie they could have deleted it.0 -

Can you please read my posts. I removed the posts, not Martin and please don't accuse anyone of something that you can't substantiate. I have not said that organising a class action is unlawful but that using MSE as a platform for organising this may well cause legal problems for Martin as the owner of MSE. These posts will be looked at by the Abuse Team as all posts removed have been reported by me.
