So the current business model is not pay any claims without an mcol hence £30 extra cost per claim but suppose 50% write it off and don't bother they can easily afford the 30 quids - has to be despicable behaviour but I suspect it may be the only way they can stay in business with no distribution agreementI think....0

Hey Magoo1406, thanks for that simple step by step process of getting your cashback, it really helps all those who have sent in their claims (me included) :T and are waiting for the 45 day reply (or not) deadline
A question, my first claim was sent in on the 8/1/08, therefore 45 days after this is the 22/2/08, once this day comes I will go through MCOL procedures and your step by step guide, but, should I claim for my entire years cashback (£480) or just the value of my first cashback which was £160
Any advice from anyone is much appreciated

I claimed the full amount (£420 plus £35 cost) on MCOL even though only 2 were overdue so P2UD have sent me the following defence (on the last day of thier 28 day acknowledgement period!!!). I dont know what to do next. Please advise.
"On 13/9/07 we received 1st correct cashback and on 12/12/07 we recieved the second correct claim. Both have been approved but it seems that they have not had cheques issued, therefore we admit the 1st and 2nd instalments at £140 each are still due, as such are issuing the claimant a cheque for these 2 instalments.
We do not dispute the value of the claim however, as the amount owing was £280. the 3rd cashback application has yet to be made, therefore we dispute any claim made for this. due to claimant pursuing a greater amount than is owed, we believe that the court costs should therefore only be £25. we will therefore issue a cheque for £305 to the claimant and intend to defend the remainder"
Should I accept or go ahead and say they broken the T&C? If I say that will I win judgement?0 -

This is what I said in my MCOL claim form.Mobile contract taken through Phone2UDirect on 28/02/07.To recieve full line rental value of £420 back I am to send postal invoice for months 6,9 and 12 by recorded delivery within 21 days from the date on each invoice along with a letter with my claim details and the original purchase invoice with my 1st claim.I have sent my 1st claim on 12/09/07.I sent my purchase invoice,postal invoice from Vodafone dated 11/09/07,issued 180days from date of connection and a letter with my claim details.Sent my 2nd claim on 12/11/07 but realised after posting that it was sent a month early so resent next months invoice from Vodafone correctly on 10/12/07.In my claim I enclosed a letter informing the defendant that they have broken their T &C by not paying my 1st claim within their specified 45days thus I will be starting legal action if I do not receive my 1st claim within 10days and also they will be liable for my costs.Only recieved response rejecting my early 2nd claim0

If that is the complete claim that you have sent in to them, then there is no detail of why you have claimed the full amount of £420.
You have only described that 3 claims were necessary, and you have so far completed 2 of them.
When they didn't pay you as agreed, they committed a relevant breach of your contract, but you haven't said that in your claim.0 -
Stupid I know, but I have no record of the 'original purchase invoice' which I gather came when I received the 2 vodaphone sim cards in Aug 07. As a result, I will be in breach of phones2udirect's T&Cs when I try to claim my 1st 6 months cashback installment.
I have tried unsurprisingly to contact p2ud by phones and email, hoping they will send me a copy, but have had no reply. I know this is my mistake, but do I have a right to expect they would send me a copy of this 'original purchas invoice', or as I am expecting, they will simply delight in me being in breach of the T&C and give me no chance to rectify the situation.
Has this happened to anyone else and is there anything I can do about it?

Their whole business is based on customers defaulting over the cashback conditions, and if you have read up on them in this thread (and elsewhere on the net) you will see they are highly unlikely to assist you.0
