I have been paid on the 10th. Mind you i need to send a letter to court to let them know that but somehow i am not pushed to speed up and let these guys off.:D0

Please could someone advise on the issue of sending the 6th bill, though it is before the 180 days. I requested them to clarify. Please see below my request, but they did not reply. Hence I sent the 6th Bill. My request to PhonesUdirect : 12 months contract, there is the following para in T & C:
N.B. For clarification the 6th month's invoice is classed as the first airtime bill issued after you have had the phone for a period of 180 days from the date of connection (inclusive). Subsequent bills will be the first ones issued after each 90 day billing period, with the first period commencing from day 180.
Date of purchase is 12 June 2007, First invoice issued is 19th June 2007 for the 19 June to 18 July. Thereafter the invoices are issued on a monthly basis by Orange on the 19th of the month.
The 180 days from the connection date is 12 June + 180 days = 11 Dec 2007. The 6th Invoice issued on the 19 November covers the period 19 November to 18 December. Although this covers the period beyond 180 days, it is issued before I have had the phone connected for 180 days.
Please could you clarify,

or
I should wait till the phone is connected for period of 180 days (ie 11 Dec) and then send the first airtime bill I receive after 11 Dec.

Hi!Looking for some advice.I have written to P2uD stating that they had 14 days to pay my cash back and if they didn't comply with that I would begin legal proceedings.Suprise suprise I have had no response. SO I called my local trading standards office - glasgow for some advice. I have been told by the helpful people at TS glw that they wouldn't be able to help me wih this case due to limits on their resources!SO does anyone know how I take this forward as I don't have any contats in England to apply to the small claims court (think that's what quentin called it?)Hope someone can help point me in the right direction.Cheers0

MCOL is not a straightforward procedure for those of us living in Scotland. I enlisted the help of my local Trading Standards, who pointed me in the right direction. I had to download a Form 1B from here: http://www.scotcourts.gov.uk/sheriff/small_claims/forms.asp#1b
and also a Form 2 from here:

In our case my wife and I took out contracts at the same time so are claiming on one action, but if anyone wants copies of what we put on the form PM me your e-mail address and I'll forward a copy to you.
I then took the forms down to the Sheriffs Court, obviously keeping a copy for us, spoke to the Clerk, handed over my £44 and they sent the summons to P2UD. I received a return date of 19th Feb, and if P2UD haven't paid before then, a representative of the company has to present themselves in court if they dispute any aspect of it - Elgin is a long way to travel from Kent to defend this....

I recently won my MCOL claim for £140 (22.01.08) by default as they didn't file a defence ( despite their initial response to the Court indicating that they would be defending entire claim amount ). 10 days have elapsed without payment so I've instructed the Court to issue a Warrant. Bailiff should be calling within next 15 days. Should see by then if it is a won't pay or can't pay situation.0

hello GH let us know how the bailifs get on with P2u , i have just issued judgement for my fourth claim with them, as they did not defend my cliam within the 28 days again . so I am in process of waiting to see what they do on this occasion .0

Hi, I have just received (and banked) a cheque for my last 2 cashback claims against Phones2UDirect. As I have found this forum most helpful in achieving this I just thought I'd summarise the steps I took as it may help others. Everything below has been covered in more detail by others in this thread who know more about it than me (thanks to them), and in my case I DID comply to their T&Cs so they could not reject my claims on that basis.
1. Send all claims recorded delivery.
2. Do not expect a response from Phones2UDirect to your claims, nor to any follow-up calls, e-mails or letters.
3. Use MCOL as soon as you possibly can i.e. after their payment deadline has passed.
4. Expect P2UD to respond by intending to defend the claim, which means they have 28 days to issue a defence.
5. Don't expect them to file a defence if you have complied to their T&Cs. After 28 days this entitles you to issue a Warrant of Execution i.e. send round the bailiffs.
6. However before I did this, I e-mailed [EMAIL="claims@securephonesales.com"]claims@securephonesales.com[/EMAIL] informing them of my intention to serve a Warrant of Execution unless I received a response to my e-mail within 24 hours. I got my response, and I got my cheque 3 days later.
7. Wait 8 days for cheque to clear (today!).
They also very kindly enclosed 3 copies of a letter of written confirmation of payment and a pre-payed envelope, which they want me to sign and return to them and the courts as proof of payment! I may eventually get round to it sometime this year - let them take me to court.0
