My cheque has also cleared ok today after winning case against them.
I also claimed the whole 12 months on the basis of P2U terms and the judge had no problem with that. My first claim was actually received by P2U about 5 days late. I just explained that I was on holiday and although I anticipated problems, I was unable to discuss the issue with the company prior to going away as they had no cashback department. The judge agreed.
Everybody who has lost money should take legal action - If the company go bust as a result, great. They do not deserve to be trading.0 -
Recieved the cheque today but they only paid the first claim + court fees. I'll now have to chase them for remaining 2 claims. Will wait for a week and will again file a small claim county court. Its better to have court case rather then writing them several times.....best way I think..0

Have they paid you the amount you claimed via the court in full?
If not, you can request a warrant from the court, and the bailiff will try and get your money for you.
But if they have now paid what you asked for in your court case, then a new court case needs a new LBA.
When you submit a cashback claim in line with their conditions and they don't pay as agreed, then they have committed a fundamental breach of the contract.
If you end up taking legal action this fundamental breach means the contract is broken, and you can sue for the total amount owed, not just the late payment. Also when submitting your claim to MCOL, you can ask for interest to be paid on any money overdue.0 -
I have just found this site and am another victim of P2UD. Have read a few posts and am spurred on to do an online claim. I gather one mentions successful cases, but without reading back through all the posts, has anyone got details of any please? Also do you just mention the case or do you have to add why the judge ruled in favour of the claimant?

Date of purchase of my phone was 12 June 2007, First invoice issued is 19th June 2007 for the 19 June to 18 July. Thereafter the invoices are issued on a monthly basis by Orange on the 19th of the month. The 180 days from the connection date is 12 June + 180 days = 11 Dec 2007. The 6th Invoice issued on the 19 November covers the period 19 November to 18 December. Although this covers the period beyond 180 days, it is issued before I have had the phone connected for 180 days. I asked for clariifcation whether it is 6th or the 7th Invoice, but never received any response.
I sent in my first cash back claim in Dec 07 with 6th Bill. Today I received a letter from Phones2Udirect saying that I have been unsuccessful.
Is there anything that I could do to get the money back, Please someone advise.0 -

Yes, use the Money Claim Online and file a case against them. File for the FULL Cashback amount, since, by their own T&C's they will not pay out any further Cashback claims that you may make.
Tell the Judge/Court that the T&C's are 'confusing', on the one hand, asking for the 6th Invoice, which was issued on the 19th November, whilst on the other hand, saying the Invoice should be the one that is issued after 180 days of connection, which would be the 7th Invoice that you receive. Furthermore, when you asked for clarification, they did not reply AND they did not give you the opportunity to rectify any mistakes, in case you did make a mistake, due to them not responding to your request for clarification.0 -

The terms and conditions are misleading, and the company will not respond to queries.
On that basis alone, it is worth taking legal action0 -
