Jamal. My advice. Dont leave it as a bad dream. You have provide them a copy of bil (online/post) should not matter what so ever are there T & C's. Just show them OFCOM rules/regulations. mail me if you have any specific querries and refer my case. rushabhjvora at gmail dot com0

When you get confirmation the warrant has been issued, contact the Bailiff's office where the warrant has been sent and inform them of the payment you have received (after it has cleared).
The Bailiff will then pursue them for the balance owing on the warrant.0 -

It took a bit of time to request judgement by default due to the problems with MCOL over Christmas and New Year. I received formal confirmation of the judgement midweek and this morning had the postman knock on the door with a cheque for the full claim + costs by Recorded Delivery. The cheque is now sitting in the letterbox at my bank awaiting their opening on Monday morning!

Fingers crossed P2UD stick around long enough to claim on my next contract... (I know, I shouldn't have taken another contract from them but I thought they had more chance than some of the other retailers precisely because they are so poor at paying up. I didn't forsee Dextra pulling their distribution agreement or OFCOM et al sticking their oar in.)0 -
I got a letter in the post today saying i sent in my first claim too early, however i sent my 6th Orange network bill. On actually counting the number of days however, it was 173 days after the date of connection, rather than 180+.
I think the terms and conditions here are misleading, as it clearly says 6th network bill from date of connection, i didnt realise i would ALSO have to count the number of days as well.
Does it look like i have a legal case to claim my cashback on grounds of misleading terms and conditions? Has anyone used this argument before?
Also I bought my Phones2uDirect contract on 6/06/07, when a different version of terms and conditions were being used by Phones2Udirect, just wondering if anyone has a copy of these, and tell me the time frame which they state cashback will be paid within?
I seem to recall it being 28 days, but iv looked on the website and there is a new version allowing 60 days to claim and 45 working days for them to pay up. Iv contacted them but no response.
any info/suggestions would be much appreciated, thanks0 -

I'm no expert here, as I'm having to take P2UD to court myself (only 4 weeks before they have to present themselves in court in north Scotland), but I would have to say that as you haven't complied with a clearly stated section of their T&Cs you may be struggling. For several edtions now they have included the following:

For clarification the 6th month's invoice is classed as the first invoice issued after you have had the phone for a period of 180 days from the date of connection (inclusive). The invoices for month's 9, 12, 15 and 18 are therefore those you receive 3, 6, 9 & 12 months subsequently.
I hope I'm wrong, but afraid I wouldn't be too hopeful.

I did exactly the same as you, by sending in what I thought was the 6th Bill (but not the one received AFTER 180 days had elapsed since connection). I had contacted P2UD on the 'phone, at the time they received my Claim, to check "if all paperwork had been received O.K. AND was it everything that they required?". The answer I received from them was something along the lines of "They have 45 days to process/respond to my Claim, and since 45 days had not yet elapsed, they could not tell me anything".
Of course, when they did reply, (on the 45th day), it was something along similar lines to the reply to you, + it was too late (since 21 days had elapsed) for me to re-submit.
Suffice to say, the Judge did not take too kindly to that - sounded a bit like deliberately making the T&C's too confusing and then not giving one the opportunity to rectify any mistakes.
Even though it was only my 1st Claim, I sued for the lot (on the basis that by rejecting my 1st Claim, according to P2UD's own letter & T&C's, they were automatically rejecting all subsequent Claims).
I received a check today, from P2UD:D, for the lot, including Court fee's! - of course, I had given them a warning about issuing a Warrant of Excecution.
Hope the check clears now!0
