  • Would people stop saying that Ofcoms Regulations have been breached as the only gave Guidelines. The guidelines are for the networks to enforce.

    We are trying to make them enforceable regulations, to clean up the industry of these misleading cash back promotions that are based on deceit.

    The Ofcom Regulations are a code of conduct with no legal status.
  • A motion was laid before parliament today regarding Cashbacks.

    Quite a few MP's are behind us (Independant Mobile Phone Dealers Association) in getting regulations brought in.

    We are also involved with Channel 4 with regards to a program under production, regarding the whole situation.
  • Does anyone have any info. as to whether or not they are still in existance? The last time I know of any communication, to anyone, was a letter, dated 3rd Jan 2008, from their 'Customer Services', which was attached to a copy of their witness statement that they sent to me. The telephone number given on the letter head was their old telephone number, that no one seems to answer(and have not been answering, for a long time now).
    I understand, they sent a similar letter to the Court.
    Could it be that they have provided false information, as to their contact details, to the Court vis-a-vis this last letter?

    :j I can confirm they are still in existance as i received my first cashback cheque Today dated the 15th for my second contract with them , including full money claim on line fees ,
    Position two contracts , two cashbacks received , 4 to go :rolleyes:

    From what you say, there is no doubt you have broken the T&C.

    So your case will have to be on whether or not the condition you broke is considered to be legally "fair" or "unfair".

    Get the best advice and opinion you can afford, (in relation to the money at stake should you win), though bear in mind you won't be able to include the cost of legal advice in your claim.

    Yeah, me too :T - only trouble was that yesterday I paid £55 for my Warrant of Execution as I was convinced that time was of the essence :mad: . Possibly it won't have been processed by the courts yet and I can withdraw it but I'm not holding my breath!

    So if anyone else has got as far as getting a judgement against them, it's probably worth holding back and seeing what happens...

    Before District Judge Douce sitting at Derby County Court, Combined Court Centre, Morledge, Derby.

    Reasons:

    "1) I have heard from the claimant in person. I find him honest and I believe him.

    2) The terms and conditions no version 3.5 regarding cashbacks is unfair. I agree with the view of District Judge Lethem-Graham V phones2udirect 6 August 2007 Tunbridge Wells County Court. The rigour and in-flexibility of the requirements are unfair. No chance is given to the consumer to recitfy any omission."



    I submitted my 6th month bill with an invoice. My claim was rejected stating that you have not submitted an covering letter. I assumed Invoice to be the covering letter required. However, in the T & C's only "Letter" word is written instead of "Covering letter" and as invoice had all my details - i.e. name, address, phone no, contract no, etc.. it suffice as the letter and I won the case. I showed in my case all the bills (past 4 months) showing the number I have called and no one picks the phone + all the copies of emails that I have send with no reply. I quoted Graham vs. P2UD case and it helped a lot as I prepared my case inline with Graham's stating that I was not given any chance to provide any additional letter and was only contacted via a letter which stated that my cash back is rejected.

    I thought this unfair and I fought back!!!

    Just represent your case honestly and you'll win.
