I too have been having problems with this company. Received my first cash back installment but have had no such luck with month 9 and 12. When I go on their website it keeps directing me to e2save - anyone know why? As I live in Scotland will the MCOL work for me?

You can use MCOL, but you must give an address in England or Wales. You don't need to live at the address, but all correspondence from the court will go to that address, and should there be a hearing it would be at the court nearest to the address used.0

From reading previous threads I should possibly send them a letter allowing them 14days to respond before I take legal action.

We also received our first cashback (eventually) but are having major problems with the second. Moray Council Trading Standards are certainly being very helpful, and have said that if the latest correspondence they have sent to P2UD doesn't work they'll assist us with taking them to court, so your local trading standards may also help. One thing they did tell me initially was to write a letter to P2UD including the phrase "time is of the essence". I don't know if that is some sort of legal requirement up here.
For what its worth I also looked at MCOL, and was simply going to use my fathers address in England.

I suspect that all of us that are owed money by Phones2U Direct are going to be disappointed/angered. Not only is their website redirecting any purchasers to companies such as e2save and Carphone Warehouse, but most links now come up with 404 Not found errors. Also e-mails sent to P2UD addresses (claims@phones2udirect.co.uk and CASHBACKS@PHONES2UDIRECT.CO.UK) are simply being bounced back as undeliverable.
I guess if the receivers are called in we won't be very high up the pecking order....:mad:
If anyone has any more useful information it would be helpful.

I have spoken to t-mobile this morning (typical I was just about to claim my first cashbakc and filled all the papers), t-mobile confirm that Phones 2u are on their list of companies that have gone to the wall.
My partner was with mobilephonesontheweb and they also went bust. So with the help of a voluntary code that was setup with all of the mobile operators July 2007 and OFCOM, Customers are being allowed to change their price plans to the lowest available. Quote this code when you speak to your network.

I just changed mine from £36 per month to £15 per month inclusive and the same with my girlfriend.
At least this recovers half of the money.
Also the contract expiry date remains the same it just reduces sthe costs until your renewals.

thank you for your help. I will contact my local trading standards office today.
I don't think I will have any chance of getting money back as my contract has ended. consequently, if they have, as i suspect, gone into liquidation' I will be way down the list for a return.
Quick question, If you have completed your contract with P2U, received your first installment but not the subsequent two, and they have went into liquidation, what are the best options to get a return?

The only thing any creditor can do if the firm goes bust is register as a creditor with the liquidator and hope there will be some money to pay out to creditors at the end of the liquidation - though as you will be at the back of the queue of creditors don't hold out much hope of getting anything back.0
