    Unfortunately you seem to have broken the rules, and up to now they haven't scammed you at all have they?

    They are not paying me almost £400 that I am owed - never got one cashback claim from them - for the sake of keeping my itemised billing. They got the front page, original invoice, and on time. If it hadnt been that, by the looks of things, they would've found some other way of getting out of it.

    Maybe; but the fact is you didn't bother to study the t&c and follow them - or chose not to. If everyone did there wouldn't be any 12 month free contracts. If you go into something getting the whole lot for free I think it reasonable to understand fully what's required of you to achieve that. These are businesses, not charities. Having said that I wouldn't touch this company with a barge-poll; but, then I not only read the t&c but researched these threads for more than a year before I went to ANY dealer.
  • I understand what you are both saying, and I know that it was my mistake, but is it not a fair argument that they do not NEED the itemised part of the bill, and that I should not HAVE to provide them with telephone numbers, some of which are X-directory? I know that it says the whole bill on the T &C, but could it not be argued that this is an unreasonable request? They have all the information they need in what I sent them to process the claim.

    Yes - but this particular problem is all your own doing.

    As things stand they don't owe you £400 at all as you breached the contract, not them!

    There is a silver cloud though, these companies work on the basis that some customers will foul up on the conditions and they won't have to pay them.

    So mess ups like yours does mean they can stay in business and that another customer who has stuck to the rules can get paid.

    The time to argue it was unreasonable was before you took out the contract.

    In fact you agreed to send them the whole bill, but failed to.

    Then you didn't read the conditions (if you had done so, you wouldn't have waited till now to complain that they are applying them correctly, and won't pay you any cashback at all).

    You earlier said you didn't send the itemised part of the bill because you "needed" it, but now are saying it contained "X - directory" numbers. If that was really the reason you didn't send it, you could have obliterated the numbers you didn't want them to know about, and explained why when you sent in the claim.

    As already posted your only hope is to get some advice on whether you can pursue this through the courts on the grounds that the contract is unfair or on the data protection issue.
  • I did send full bill from air time provider , jumped through all other cashback hoops no problem and they still havent paid my cash back :mad: , so I am in the process of taking them through the small claims procedure , they have responded to my claim saying they want 28 days to defend it , I cant wait !!! I am really hoping that it actually makes it to court so I can show them how organised I am in preparing my details , another post suggested that they had been successfully sued 12 times this year , bring on the next one , message to everyone else , if you are sure you have complied with all conditions , and can prove delivery go for it , doesent matter about proving what was inside the envelope , as I have heard on previous ,this is total rubbish .

    Don't know if anyone can help? I've read many threads already but I seem to have experienced a different kind of problem:mad:. I sent in my sixth month claim on time and with all the necessary documents as specified in their T&C's. The problem is that they ask for a covering letter and I didn't note on that letter the WEB reference number! Because of this they are refusing to pay and have declined my claim, this also means I can't claim for months 9 and 12. The operator I am using is 3 network. The details of the reply from Phones2U is

    Dear Mr *******,

    Thank you for your enquiry.

    The reason your claim was rejected was because you did not
    incluse your WEB reference on the cover letter.

    Our terms and conditions are precise with regard to when
    and what we require of our customers in order to make a
    successful claim. We request a cover letter with the claimants
    name, address, mobile no, which they are claiming for, and the
    order/invoice number. With such detailed instructions available
    to the customer we do expect claims to be submitted correctly.

    Cashback is a promotional product and many of our clients have
    successfully claimed. If the client follows the requirements
    laid out in the terms and conditions and applies correctly,
    payment is made.

    As we follow a strict course of requirements, due to the fact
    that our cashback is a promotional product and very competitive,
    all claims must be reviewed in the same manner.
    We can not change the rules for individual customers.

    Your claim has correctly been rejected and our decision will
    stand.

    Is it worth submitting a claim through the small claims court
    for £30 or do you think I am to blame and I don't have any rights
    to claim any of my cashback :mad:(£35 a month for 12 months!).
    Any help would be much appreciated.

    You have breached the terms by not complying with them.

    You could consider getting some advice on whether you could take this to court and claim the contract conditions you have broken are unfair.

    (The court fee structure has changed, and to get this to a hearing will cost £50 (claim up to £300), or £85 (claim £300 to £500), in court fees, apart from your costs in getting advice)

    Hi There
    Several months ago I posted my problems with Phones2U cashback. You may be interested to know that I subsequently issued a claim in the Small Claims Court, to which they initially issued a defence. I consulted with our local university Law Clinic (A great free service) who advised me that I had a very good case - mainly based upon unfair contract terms. It took almost 6 months to get to court, but the week before the hearing, I suddenly received a cheque for the total cashback plus the court fee from Phones2u direct. No letter or acknowledgement, just a cheque, so a good result!:j
