In his case they paid up in full prior to the hearing. It might be worth finding out what conditions he was going to challenge as being unfair.0 -

Hi shell820810, just been reading your post and I did the exact same thing. I didn't send them the full invoice just the first page (original copy of course!) and they didn't mention anything regarding that, however I didn't put the WEB reference number on the covering letter:mad: and that's why my cashback claim has been rejected! I'm still going to try and appeal through the small claims court £50 ouch and I'm not really sure I have a case though.0 -

I have done the same for mobileshop.com last month and they paid up but I have a feeling P2UD will make me go all the way with small claims. Many thanks in advance.0 -
wanted to share further update
on my case after sending two letters and various e mail's they have paid me the second claim on 19/07/07 which is almost delay of 2 months... i am still waiting for my last payment...moral of the story is don't buy any more phones from them and keep trying if you have done everything according to their terms and condition they will pay......my last cheque also proves they are still in the business and are still playing the old games.

dated 23/07/2007I post back my last cashback claim in March and only received my final cheque last week by taking them to court. I sent numerous letters by recorded delivery and email requesting payment, which where all ignored. From reading other peoples posts and from my own experience, I think they have a policy of not paying final payments unless you issue a claim with Money Claim Online.

I think you were right they still are holding on to my final payment. After sending them many letters and e mail finaly I have applied through money claim online. Today I have received a letter from their famous sales manager that they will defend the claim.Since it is my first experience any useful tips will be appreciated.

This may just be a delaying tactic. Saying they want to defend your action extends the time before they have to pay you.
Just wait until the court send you their defence, or the time they have to submit a defence has elapsed.
If they do submit a defence, the court will tell you what to do next. (Don't reply to the letter you have got from the Sales Manager).
If you haven't heard from the court about this when the 14 days are up after the summons has been issued, then ask the court for judgement by default.0 -

I was able to get first two claims by threat of legal action by sending them letter before action (by recorded delivery). With last claim they have been coming back with the same replies as mentioned by you...in your case keep trying they should pay and they will pay..don't let them get away with it..even if you have to take them to court..keep all the paper work..it is a pain but nothing is free in this world..good luck

I also think this is a delaying tactic, I received a copy of the acknowledgment of service from the court saying Phone2u intended to defend part of the claim, this allowed them an extra 14 days. The Notice of Issue you received from the court will give you a date that claim will be deemed to served. After 14 days after your can enter a judgment against them.
If you are unsure of what to do next ring Money Claim Online, I found them very helpful.0
