A number of people have requested the text I used in my claim against Phones 2U. This is the actual text minus the dates. Money Claim on Line restricts the amount of characters you can use in the particulars of the claim hence the lack of spaces after full stops.
Phones2udirect have failed to comply with
the terms of a cash back contract for two
mobile phones.Under the terms of the
contract to claim cash back I was required
to send them the original invoice from my
network provider for the month I was
claiming for, which must be received by them
14 days from the date on the invoice
(inclusive), along with a letter requesting
the cashback.The original invoice form my
network provider dated ____________ was
sent along with a letter requesting cashback
which arrived on____________ by Royal Mail
special delivery, within the specified 14
days.Letters where then forwarded by Royal
Mail recorded delivery on two occasions
stating that under there terms and
conditions, I expected to receive payment
according to the timescale quoted. Unless I
received payment I would then initiate court
proceedings. All letters requesting payment
where subsequently ignored.0 -
Have received their defence this morning. Apparently it was a simple misunderstanding - the cheque should have been raised to me. Not sure why they couldn't tell me that when they were esculating my claim or when they received my intent to sue or why they needed an extra 14 days to work it out but I will be telling that to the judge.
They also won't pay until 20th Nov though which is their next cheque run apparently! I asked for interest and they have ignored that so I am about to fax the form back to say I will see them in court.
This is a game to them (although how Mr Bunce sleeps at night after spending his day doing this to people I do not know) but I am actually enjoying now and I will win!!0 -
I've received a second rejection letter from Alan Bowen at Phones2U. Basically I forgot to put the WEB reference number on the 1st covering letter:mad: ! Does anyone know if this is worth pursuing through the small claims court or do you think I am just wasting my time plus an additional £50! Everyone else on the forum seems to have sent the wrong statement (one month early)!0

If you have a legitimate case from the first rejection, then there is no need to make another claim.
Make one claim for the whole amount due under the original deal, on the grounds that they have committed a fundamental breach of the contract by not paying the first claim.0 -

I am also in trouble. I send my first cash back form two months ago. Its in correct month. But until now I haven't received any information. I try to contact them in their customer service number and they just saying I should send a mail only as they can't give any response over phone. So, I send around 10 mails to them but no reply.
And recently (3 weeks back) I send my second cash back voucher also. Please could any one help me how to get this cash back?

Hi Quentin, thanks for the response. My second claim (month 9) is due, should I not claim for this as they have already told me that the first cashback is rejected therefore voiding all future cashbacks? Or should I send it anyway and use all rejection letters (months 6,9 & 12) and correspondence for the small claims court in order to claim the whole amount?0 -
Isn't this the same question?
If your first claim was correctly rejected, then all future claims are void.
So you need to win a court case on the grounds that the first claim was wrongly rejected.
My suggestion is that if you do have grounds for this, then you should claim the whole amount as their failure to pay you is a relevant breach of the contract.
Conversley, if you have no grounds to sue them for the first rejected claim, then they are correct to reject all other claims.0 -
