I too sent in one bill too early - the sixth bill instead of the seventh. The letter rejecting my claim conveniently arrived just over six weeks later - therefore not allowing time to send in the correct, 7th bill, within the two weeks allowed. However, as I had been concerned that no cash turned up, I had telephoned Phones2Udirect three times during the period when I could have sent the correct bill, but their answerphone just said that I should call back in business hours - although all my attempted calls were between 9 and 5.........so I e-mailed claims@phones2udirect querying non payment (still within the time when I could have sent the correct bill) but received no reply.
So this company are definitely rubbish and I would not touch them with a barge pole again. BE WARNED. In the meantime, I have sent copies of my complaining letters and e-mail to O2, and wonder if with my 'evidence' -e-mail copies etc, I can make a claim in the Small Claims Court - has anyone tried? Alternatively, can I cancel my contract with O2 as it looks as if there is no way that I am going to get any of my cashbacks back?

    Everyone

Keep us all informed of your progress with these cheats.
We should share the information needed to take them to the small claims court.

I think they are in breach of contract (or something!) by not contacting us within a reasonable time to advise on rejection of claim.

We're talking £100s each that Phones2u owe us

Can anyone verify this is a legit site for making small claims. I filled in my details but it wouldnt take my card. Also at the end it asks what country youre from. So I just blocked my card. Heres the link:

Now back from hols. - down to the local county court for my claim forms too.....
  • Hi, I've just had exactly the same problem with phones2udirect. I took the same deal as kpshah on 4th Jan 2006. I received the same letter as you. I dug out my July bill and posted it off to the sharpish with a covering letter requesting my cashback, and I just got a letter today saying it was not within there 14 day terms and conditions so they are refushing m cashback claim. Their latest terms and conditions state 21 days. They did not inform me that they had changed. Has anybody get from version 3.0 to 3.3 terms and conditions. As Im taking legal action in the small claims court, letting the kent trading standards get involved too. Cheers

I have a copy of version 3.0 from December - it states
'must be received 14 days from the date on the invoice (inclusive)'
I can send you the full text
