You haven't lost a grand, it wasn't yours to start with.

If he ends up owing the bank £1000 and is unable to recover the £1000 from the car seller, then surely he has lost £1000?

you say the bank manager says the video evidence is out of bounds, then maybe thats because they dont have any video evidence ??
there takings did not add up at the end of that day they were £1000 short and decided to pick on this person as he took out £4000,
they are probably tryiing to get £1000 back any way they can before head office find out theres a mistake on the balance that day !!

u said in this post the manager rang u, now u r saying the cashier rang u?
u also state in op they would call police if not returned by 5pm now u r saying u think they might call police? xxxx
also u would have been given a reciept, or ur cash machine statment would show the transaction xxx
u went somehere to see the car u obviously didnt meet him in a layby to purchase the car so return to where u bought the car from.

They both rang me! And the manager did say they will involve the police. and I wasn't given a receipt. My statement does show a transaction of £4k. Sod it, I can't be arsed. If they want the money back then they will have to call the police and leave it to them to decide.
  • Oh by the way, incase anyone is wondering... it was Nationwide in Birmingham, Coventry Road... its not a big branch, just a few cashiers. NAMED AND SHAMED!:rotfl:

The bank has video footage suggesting they gave you 5000. Who's to say the cashier didn't have a doctored bundle. Except the bank and the cashier.

You asked for £4000. You signed a chit for 4000. You got 4000. (as far as you know).

If they can't prosecute celebs for taking drugs from video footage you can't be prosecuted for having had too much money from video footage. That's not cocaine, and those aren't £1000 bundles.

The bank might close your account but I don't see they have a leg to stand on for taking any money off you. ( that would be theft)

They are more likely to sack the cashier and the manager. When I used to handle large sums of money I/the bank I worked for would double check. Even just visual double checks. i.e. That's £4000, why are there 5 piles? its a simple procedure designed to stop this kind of mistake.

Stick to your guns but separately see if you can get the cash back. Once you have the cash back, stick it in another account and get some interest until the mater is resolved.

The manager probably hasn't told his bosses yet and is trying to get the cash back without admitting the error.

However in the case of 'The Bank Vs Harry112', they appear to have proof of the overpayment

Do they? Harrys got proof in the form of him request was for 4k, and his online banking says he took out 4k...the bank is telling him they have the evidence but won't show it him. Very suspicious behaviour!

Harry, just make sure that whatever you do, you don't get scared into handing a grand over. Have they said why you can't see it?

In fact, just like someone else mentioned - just because it's on video evidence as handing over 5 bundles, doesn't mean its 5k, after all, Amy Winehouse was snorting sugar on those photos.

and for the sake of the other posters on here who've taken time to advise, I hope you're genuine too!)

Me too, I'd worry about his sanity if he's pulled it out of a hat :rotfl:

If you haven't already - print off your online statement...

If it were me, I'd probably go see the police before they come and see you (least that'd remove the ability for the bank to continue using the police as a threat), explain everything and see what they suggest, but then I like a man in uniform so I might be a little biased :j

I once got a phonecall form a cashier at RBS because she had put the wrong amount on the credit paying in slip. They rang me at home ( acording to my mum) and at work and I had 3 missed calls on my mobile- so cashier do ring it does happen. x

The only scenario I'd believe here is that the OP really did get an extra £1k and *knows* he got it, but is thinking of a way of keeping it - and testing the story here first. So a car purchase from a mysterious trader who doesn't count money or give receipts is the best you could do eh...
