How do you know you handed £5k to the car trader?
You are believing what the bank is telling you but until they provide the evidence then how do you know it's true?
I cannot believe that a cashier would hand over a grand by mistake.
One extra note maybe, but that's one hell of a !!!! up if you ask me. If the bank is so confident that you received the money then the onus is on them to prove it.

I would write a letter to the bank complaining that you have been upset by their accusations and have lost sleep over this and unless you receive a letter of apology and some comp for the stress that this has obviously caused you and your family, that you will take further advice from your solicitor, ending with 'And I await your reply'. and see what happens.
COULD turn in your favour.
PROBLEM here is that if you told the bank that you handed the money over to someone without counting it, they could, in theory, take the view that you are unable to disprove their accusation. Very interesting.

I find it very hard to believe that you A) walked away from the teller without counting the money, yourself. And
that the seller of the car walked away from you without counting the money first.

I can, actually. It has happened to me. I cashed a check for $900 in America and noticed that she'd sorta fumbled the money while counting it to me. When I counted it, there was $1400 instead of $900 - she'd given me $500 too much.
(I did return it, but it wasn't very pleasant. I felt like Whoopie Goldberg in Ghost, when she has to give that check to the nuns. I also had to stand in that very long line again and the teller was quite snotty about the whole thing. Sometimes, virtue is its only reward.)

A few days ago I rang my bank and asked to take out £4000. They told me to come in yesterday. I wasn't paying attention to the cashier counting out £4000, when she finished she put the money in the envelopes and gave them to me. Soon as I left the bank I handed the money over to somebody who I owed without opening the envelope as I assumed it had £4000 in there. However, later on in the day I received phone calls on my house number and mobile number and a letter through the post personally dropped by the cashier, they said that I was actually given an extra £1000 and they are asking for it back. I'm not sure whether they did as I wasn't paying much attention as the cashier was counting the money. But they say they have video evidence that she accidently gave me an extra £1000. What do I do? I can't get through to the person I gave the money to because his mobile is switched off and I do not know where he lives. I owed him money from a car I bought. The bank said that if I cannot get the money by 5pm the evening then they will inform the police. Can they do this? Will I be in trouble? It's not my fault, its the cashiers.
