why don't you go down to the police with your log book and take some advice. That would be my first step, have you not got any further info on this trader than a mobile number? Where did you buy the car from ie ebay loot, why not have look on there and see if you can trace him that way.

If you do find him you could advise him you ahve been to the police and did he accidently get an extra £1000. However if he blags you and says no, I think you are stuck as I doubt you have cctv to back up what you gave him.

Good luk let us know the outcome.

    What a dodgy story :rotfl:

    1. You bought a car from a trader with no address
    2. You took £4k out the bank without checking they gave you the right amount
    3. You handed over said money without counting it
    &
    4. What has this got to do with credit cards?!!

Very strange story but made me laugh :rotfl:
    HAHAHA LMFAO!

But if its there fault then why should I suffer and loose a grand??

Fault is not the issue. You were only entitled to £4k.

In Common Law, you are not entitled to profit from a mistake.

yes the bank said they have video footage of the cashier giving me 5000. The cashier didn't confirm how much she put in. She just put it into the envelopes. The manager rang me and wanted the money back, and I exlpained the situation to him. I think they might involve the police, but I cannot trace the other guy back.
NO cashier would do that... they ALWAYS count it as they hand it over... even if its small change coins!

focus on that with your complaint...

Could the trader and the cashier know eachother?

  • I really don't understand why a basic cashier would contact you direct or post a handwritten note through your door. I would have thought that for sucha sum of money, a branch manager would have been dealing with it. After all they are responsible for the staff and will be as answerable as the cashier.

If you weren't paying attention to it being counted then why would you hand it over to someone without checking it properly.

If the person selling the car is a trader then he would have given you some sort of reciept or base where he sells cars from.

I've a funny feeling this story is not ringing true....sorry.

I just don't understand how you could be so blase about £4000 (or £5000 if it really happened)

And yes, if you get £20 instead of £10 from a cashline you need to pay it back. If you go to a cashline and there is money hanging out it you have to hand that in or it is classed as theft.

You would have watched it being counted, u would have counted, the car dealer who u dont know would have counted, so they gave u a car without knowing u and let u pay them later and didnt check what u gave them? no!!!.........like a previous poster states, u know where u bought the car so go back there, if it exists, story really has too many holes in it. xxxx

Just a few points (if people can see them in between the sqabbles  )

    1) Make sure any dealing with the bank are with the manager, and not just the cashier - just to make sure it isn't the cashier trying his/her luck.

    2) Ask to see this video evidence they have, and preferably take a copy of it with you.

    3) If they say they're getting the police involved. That's fine. I really don't think there's a criminal offence here, as you didn't knowingly steal their money like they're making out. Don't let them bully you with threats of the police. Actually, if I were you I'd probably have a trip down to my local station and explain the situation, see what they say and where you stand.

    4) I assume you have a receipt that says you withdrew £4k?

    5) So the man you bought a car off trusted you enough to not count the money you gave him?

    6) On the documents of your new car, is there no address of the previous owner? (Ie Mr happy chappy who's probably down the pub now, celebrating his sale!)

As a side point - on the occasions that cash machines are loaded up wrong and they give customers £20 notes instead of tenners, do the customers have to return the money in those circumstances?

I've asked to see the video footage and the manager said im not allowed, its out of bounds. I signed a receipt in the bank but that was the banks copy, I havnt got a receipt or any piece of paper stating I took out 4000 other than my online statements. The man I took the car off was kinda in a rush and didnt really bother counting the money fully. The cashier who gave me the money even rang me and asked for his phone number and if I knew where he lived. His name isnt on the v5
    Thanks
