Parking ticket in Asda car park - Is this legal, can they take me to court?

    I'm not trying to put "people" off. I have tried (and failed) to show you your opinion is irrelevant.

    Moral issues don't come into this.

    The Board is intended to save some money, not worry too much about whether Asda is right in sending out pseudo legal notices!

    Says who??

    It is a forum where all relevant issues to the original post are discussed. And as most posters believe, the morals of this subject are relevant. It's not for you to decide.

    i read somewhere, possibly on here that the disabled bays at supermarket etc car parks HAVE to be registered with the county council as disabled bays, or the ticket is not enforceable. may already be on this thread though.xx

    I'm not going to get into this debate apart from saying that you are not liable to pay any fines to private parking firms.As other people have said,just ignore any letters,and eventually they will stop.DO NOT say who was driving.There is an amazing site called pepipoo.com with all the details of law on this and any other motoring problem.

    If you allowed someone to use your car, and they commit a traffic offence, then you refuse to give the driver's details, then you are held responsible.

    And if they don't, then they are responsible. I have it in writing from Norfolk Constabulary.

    Wherever you read it, it's wrong. A car park owner must provide a certain number of disabled bays. However, in a private car park, those bays have no legal standing so far as drivers are concerned. Even though they must be provided by law, there is no legislation that says they can only be used by blue badge holders.

    The most that the owner can do is to send you an invoice, which is ultimately unenforceable in a free car park.

    In the case of a PCN or FPN for parking, the RK or owner is ultimately responsible.

    In the case of a request under S172 of the RTA, you have a duty to use diligence to identify the driver. If you do not, then you are liable to a fine for failing to provide information. As RK, you are not liable for a speeding offence if you were not driving.
