  • Just wondering if anyone has heard back from the police at all? If there is anything going on to bring a prosecution against this **** would that help the outstanding claims and complaints against paypal??
    Alternatively can a group complaint be made to paypal to highlight the full scale of the fraud?
    It is shocking that there are so many loopholes in this protection policy and that paypal actively encourages us to use debit cards and direct payments from our bank accounts instead of credit cards when clearly credit cards offer the best protection. I will certainly never pay any other way in future - but what a flaming way to find this out...

    PLEASE PLEASE PLEASE everyone who got an email saying that they had won the case but cannot be refunded please put in a complaint about Paypal, I had to send a couple of emails to them but they cannot not pay out! They are just trying to fob us off
    I dont agree with the person who posted saying we should phone Paypal, if you email you have everything in black and white and nothing can be disputed, just remember to save all your emails! Thats just my personal opinion, no offense meant to the poster!
    I hope this helps those of you still waiting for your refunds and been told there is no money........there is, Paypal have to pay out!!

    So as long as you have purchased through eBay, and provided you used an eBay invoice or the Pay Now button to make the payment, then you are covered by Buyer Protection and you are entitled to a full refund (as long as the dispute was opened after the new policy came into force otherwise the cover shown on the listing).

    If you paid through a PayPal invoice, or sent money to an email address requested by the seller then you won't be covered by Buyer Protection.


    If you are sure you met the criteria for Buyer Protection but PayPal hasn't given you a refund - saying the seller doesn't have the funds - then you need to phone PayPal and get PayPal to put it right.

    Sorry been out all day ! I bought via the Buy It Now option on the 13th Sept , paid via Paypal by hitting the pay now on the Ebay auction bit , Paypal payment was made from my Lloyds TSB DEBIT VISA card ( I changed the option from straight from bank account to card payment in case it went t*ts up ! ) . Opened the dispute and escalated straight to claim on the 8th Oct and found in my favour on the 19th Oct and money was back in my account by the 22nd Oct .
    Baby Thomas born 3 months early by emergency section on 21/1/09 weighing 1lb 15ozs .
    Thomas came home after 3 months and 2 days in hospital weighing 5lb 15ozs
    Thomas weighed 21lb 4ozs on his 1st birthday , a total weight gain of 18lbs 5ozs !
  • Thanks for that. the difference between us is you paid through ebay and I paid through web site! Gald thats cleared up!. Think it was a big mistake buying from website as this seems to be the sticking point for not getting money back. Gonit to ring paypal anyway and ask about this muddle. have had a form to fill in fromn bank. that sounded promising, except one sentence... 'we'll make a descision when we can credit your account'!!! I don't like the word WHEN!!!!:eek:

    AS you did purchase from the website and not ebay , Reckon paypal will point you to the User Agreement - Buyer complaint policy, which Unfortunately does state that recovery of any amounts is not guaranteed and is limited to the amounts that PayPal can recover from the seller’s Account, even if it finds in your favour.

    Fingers crossed that your bank will refund you soon like you say receiving the form does sound promising

  • I too was scammed by this man.

    I paid by paypal on using 'buy it now' on Ebay. I put in a claim on 18th October which was immediately escalated. I then received an email from paypal on 29th October saying there were no funds.

    I was incredibly upset but then through browsing for information about this scammer I came across this thread. I spent a long time last night reading every last post and it was worth it.

    I phoned PayPal this morning and told them the incorrect policy had been used to resolve my case. The advisor I spoke to agreed and told me my money would be refunded in full. It took less than 10 minutes. So don't give up if you paid through Ebay.

    I want to say a big thank you to everyone who has put in the time and effort to help those (like me!) who wouldn't have a clue what to do. I would have walked away £99 worse off. For many of us new or expectant parents there isn't a spare second of the day so hats off to you all.

    I may be getting my money back but it doesn't stop there. These scammers must be stopped. I will be contacting the police about this matter later today. Please, everyone who this has affected, lets try and stop this scammer from doing his dirty work again.
