First time poster and I wasn't expecting to be posting in this thread
We[STRIKE] are so happy with our timeshare[/STRIKE] can't wait to get rid of this damn millstone. We bought points of GVC about nine years ago and want out.
What is the best approach? Sent the certificate back? Just don't pay? Send a letter of resignation?

First off, back-track from here to identify specific points of help in this thread (several MSErs have been extraordinarily helpful not only with info but with many a useful website link.)
Then: cancel any SO or DD you might have. Finally: drop DR a line, politely pointing out that due to the company's unilateral revision of contract, what you have now is not what you originally agreed, and that had today's terms & conditions prevailed at the time of the original contract, you would never have joined the ownership scheme.

:eek:I have had an unsolicited letter from 'Diamond Resorts' offering me a 2 night break in a luxury apartment in the UK (Devon/Staffs/Lake District) for £69, just for listening to their 90 minute sales pitch (timeshare).
Now, I have NO intention of ever buying a timeshare, but is it worth that 90 minutes for a super-cheap break? My 'too good to be true' radar suggests it probably is a bit rubbish, but has anyone else used them? Any cautionary tales etc?

Hello quarky we have also just joined this forum. We have a similar situation to you, first brought our points from GVC many years ago. We have not paid our membership fees for the past three/four years. We have tried on numerous occassions to dispose of this ball and chain around our necks. Spoke to DRI several times explaining we no longer can pay/afford membership fees and that there is no availability for family holidays/outside term times. We tried re-sale got involved with incentive leisure ( another scam) costs involving solicitors. We have now received a debt recovery letter from Daniels Silverman stating we owe more than originally stated in this years 2011 fees. This has worried us considerably and are considering contacting Lawyers - Linder Myers who are trying to gather a group of DRI members to take legal actions. Would appreciate your thoughts. thks0

I've just come back from a week in Pine Lakes with DRI and have brought some points, but I guess from these threads that I would be better off cancelling whilst I can???????0

yesterday received letter from "Daniels Silverman" demanding our outstanding management fees of £4895.75. (3 years unpaid)
today received an email stating same.
i responded by email:
Dear Louisa,
I have had numerous telephone conversations and written correspondence with Diamond Resorts (formerly Sunterra) about the cancellation of our regisration and membership.
Due to the companys unilateral revision of contract, what we had is not what we originally agreed and had todays terma and conditions prevailed at the time of our original contract we would never have joined in the first place.
We, amongst many others, are currently consulting with legal representation to establish our claim for compensation for breach of rights from your client.

Her response was swift and to the point :Thank you for your email.
I must advise that you are not able to cancel this membership as you believe. You signed a fixed term agreement which is a lifetime membership.
You remain liable for payment of the management fees, please arrange for payment to avoid further action being taken.

It was such a relief to find there are others out there feeling the same, I am so fed up with Diamond and lack of interest in their members, but I have to ask those of you that are refusing to pay their fees, don't you stand to lose all the money you've invested in your points, thereby not being able to sell them until you've paid your Management/Membership fees??0
