    Result. I was taken Currys to small claims court under SOGA and issued papers and they have settled in full plus costs

    No they haven't, see page 27, 3.57 from HERE. "If the goods are faulty or do not comply with the contract, you will have to pay for their return whatever the circumstances." This comment is directed at the business!

    I have a Sony erricsson c905 pay monthly contract and phone from orange. the main ear speaker has stopped working so i can't hear anyone except on speakerphone. It is just over 6 months old.
    I called orange and was told to contact the manufacturer as its older than 6 months.
    I queried this with them as I had read here about my contract being with the retailer - Orange - not Sony. They said that it was not their responsibility.
    It seems unclear to me after reading the posts here and also on the what consumer site under returning faulty goods
    does anyone know what is the position after 6 months? has anyone ideas what i can say to orange to show they are wrong(if they are?)

    Did you 'buy' (or, I guess, were supplied by) the phone from Orange direct, or a 3rd party retailer like phones 4 u? Your contract is with the people who supplied your phone, but tbh it may be quicker and easier for you just to contact sony ericsson and let them sort it out, although you are not legally obliged to do this.
  • Online TV order not being honoured.

    Hi - I'm sure I've seen a big discussion about online offers being advertised that are then not available or the company says are an error, and now I need it I can't find the information anywhere...

    I ordered a television from an online company a week ago on Saturday. I contacted the company on the Tuesday and they said the credit card was not at the same address as the delivery address and could not process the order. They were correct in this - it was my partners card at a different address, so we then updated the card information to the correct address. The TV company said they were unable to process the card and would do it the next day once the credit card systems had updated the address information. I thought this was dubious but gave them the benefit of the doubt, and patiently waited until the next day. When I rang the TV company they said they were still unable to process the card. When we contacted the credit card, they advised us the card had been authorised for the payment and even gave us the authorisation code. This continued for another week - the TV company arguing that they had not processed the payment and it would refresh overnight and show up as not taken on the credit card statement, but the full sum of the TV order being missing from the available credit on the credit card balance. A day turned into two and then a whole week before the sum came back on the credit card. I then reprocessed the order, and had confirmation from the company that it was being processed. I expected to hear from them, but nothing. I contacted the today and they have advised they have none of the televisions in stock anymore and are not sure if they can get them at that price.

    Ordinarily I would go elsewhere and have nothing to do with a company that gives such shoddy customer service, however the television was offered at a really good price.

    I'm really frustrated by this, as I actually placed the order 11 days ago and it was due to the TV companys handling of the order that it has taken so long. They were aware of my order, so my belief is they should either have told me back then that they did not have sufficient stock, or they should have kept one reserved for me. Is there any course of action open to me?

    Sorry for the long winded explanation - hopefully it makes some sort of sense!

    i bought some studio speakers earlier this year, ex demo, and without boxes and at a reduced price. about 3-4 weeks ago one of them stopped working (in built amplifier problem) so i took the offending speaker back to the reverb store in sheffienld where i bought it. after about 10 days i tried to call them to see how it was going but couldnt get through. after a week of trying i called the mail ordeer hotline which said the store had now closed and i should call back the sheff store next week to talk to a guy who is sorting out the back orders. finally (about 10 days later) i got in touch with the guy left at the store and the problem is this:
    -no box for the speaker: the store manager (that commuted from leeds) personally took the speaker to the repair centre in leeds.
    -speaker now fixed: but no store manager due to shop closure
    -the repair centre wont post the speaker due to not having a box
    -and now ive been told the only way to get the speaker back is to go to leeds to pick it up myself from the repair centre.

    problem is, i dont drive, hence why taking the speaker back to the local store i bought them from.

    i need to phone them back to complain about this but im not too sure what rights ive got. any ideas?

    ive had to borrow some speakers off a friend so my business still has the ability to run in the mean time. not ideal though.

    Rather than waiting for a reply why dont people who got a consumer problem contact consumer direct or search for the sale of goods act, rather then just post a question which can easily be answered in advice below or consumer direct

    Or maybe this site and the forums should be deleted and people should know for themselves exactly where to look for the specific advice or piece of information they require. Personally I don't remember everything I've ever read or know exactly where to look for everything I don't know. I do find MSE to be a useful place to dip into and look for information - apologies if trying to get some advice from other people is such a no-no.

    You have certainly been messed around by this company - who is it?
    Unfortunately you have no right to the TV at the advertised price. It is purely an invitation to trade. Most companies do not accept an order as firm until they send a confirmation order. Sorry.

  • Cheers, the place I was originally buying the telly was a company called electricalexperience.co.uk and also trading under tvandvideodirect.com. I would definitely recommend people avoid these places!

    I've managed to get another good deal from GiantBuyer.com - I rang the number given, someone actually answered the phone and checked availability as it was showing as the last one in stock. They even took my details and reserved the item until I had completed the online order. Now that's customer service!
