Hi there, I have a problem with QVC regarding late delivery & also poor service from the delivery company Famac. Hope someone can help me out.
I bought an item from QVC on Friday 19th august which according to their website was shipped on weds 23rd August. QVC said that delivery takes 5-7 working days from payment (although they didn't take money till AFTER they shipped it?).
I rang them on Friday past (8th) to cancel my order under the Distance Selling Regs(?) as it had not arrived within the stated time but they said that they couldn't cancel it as it was on its way to me. I said that it was too late & I no longer needed the item. I asked if I could give it back to the delivery man & she said that I could refuse delivery & Famac would automatically return it to them & that signatures etc were not necessary - I'd asked her what I needed to do/sign.
She also said that as I don't live on mainland GB, then the 5-7 days thing doesn't count & that Monday 11th (today) was the last day for delivery. I'm not sure about these calculations though & I certainly wasn't aware about the extra time when I placed my order.
Well I crossed my fingers & hoped that the delivery would NOT be today but guess what - it's arrived!
Now I have a 2nd issue. I saw an unmarked van (white!) pull up outside & a guy jumped out while the driver went to turn the van. I went to get my keys but by the time I opened the door, the van had gone! However there was a parcel worth over £100 sitting on my doorstep in full view of the street! I think that's really shoddy service! What would I do if I hadn't noticed the van or hadn't been at home & the thing got stolen? Anyway it now looks like I'm going to have to pay postage for something that's no good as it's too late.
Does anyone have any ideas about what I can do? I really do not want this item now & I do not want to have to pay out 2 sets of postage charges.

Although you haven't had very good service from QVC or the delivery company I don't think you have a case against them.
I think the best you can expect is some limited compensation for the delay. Try writing to them.

A couple of weeks ago I purchased an Asrock motherboard from Terabyte Computers using my credit card. When it arrived, I discovered they had substituted my order for a different board (an Asus motherboard) as mine was out of stock. I wasn't too concerned at this stage as the make wasn't important, the features were and the new board has all the features I wanted. They also only charged me for my original order.
I plugged the board in and it didn't work. I tried it with several CPU's, RAM and PSU's, all known good parts and it still didn't work. I might add that I am an A+ qualified PC Support Engineer with 10 years experience. I informed the company within 7 days of receipt that the board didn't work and they issued a RMA number to return the board. I posted it back at my expense.
As I had not hear from them in about 2 weeks I contacted Terabyte computers who confirmed that they had received the board and tested it and found no fault with it. As they had found no fault the board would be returned to me after I had paid a £25 testing fee which is clearly stated in their terms and conditions on their website.
Obviously I do not want to pay this fee and I want a working motherboard or a full refund. If I attempt to return the item under the sale of goods act, they argue that the item is not faulty (so is therefore fit for purpose) and if I try and return it under the distance selling act (through them substituting my order), they say the item must be unopened which it obviuosly isn't. also I didn't notify them with 7 days that I wished to return it under the distance selling act.
What else can I do or am I screwed and will just have to pay the £25 or let them keep the motherboard?
Many Thanks in advance.

If the item cost was £100+ speak to your credit card company and tell them they are equally liable for the problem you are having.
It looks as if the dealer has you over a barrel if your card company can't help. If their terms and conditions covers the £25 fee then you will have to pay it. The only thing I would suggest is to ask them either to supply the original board you ordered or at least supply a different one of the substitute model so you don't get the one back again that you can't use.

The following is a list of food complaints which, on the whole and due to the nature of the processes involved, are unavoidable and so would not result in the Regulatory Services Division taking any formal action. 3 weeks ago I purchased a Broccoli Mornay from Asda, broc, tomato sauce, white sauce, cheese topping.......
And part of a blue plastic bag - with hairs attached. Took it back to Asda, and got a standard "so what" letter, with a £15.00 gift card.
Stupid me never took a backup photo.
Today, I bought a "fresh" chicken.
Fresh is the operative word, it had still got this mornings breakfast inside it, gunk, gravel, and CORN !!
This one's going to the environmental health
Whats going on Asda ??0 -
Hi, I hope someone can help me with a problem regarding my laptop.
I bought the laptop September 8 2005. I was told that if anything went wrong they would repair it but that was only for 1 year. Just before the year passed the CD/DVD drive was not being picked up by the computer. I took my laptop back to the shop and they told me I had to take it to PC World to have it repaired. I don't live too close to a PC world but I did eventually get there (September 8 2006 is creeping up really quickly by now) and they told me "Ring this number xxxxxxxxxxx and someone will come out and fix it". This is the part where I realise I was stupid because I forgot to do that seeing as I don't use the laptop much. Now, obviously, the year deadline has passed and I still don't have my laptop fixed. Since this is a manufacturing fault should I be expected to pay for it to be repaired? Or can I say that I was messed about with getting it repaired (being sent around the proverbial houses) and that the 'damage' was sustained before the year deadline?
Please, someone help I have absolutely no idea what I can do in this situation.
Many thanks in advance for anyones help!

The responsibility for repair is from the retailer where you bought the laptop.
Write to them detailing the full story and demand a repair or a replacement.
Send a copy to their head office as well as the branch you bought it from. Send by recorded delivery. Also tell them that if you do not get satisfaction in 14 days you will take them to the Small Claims Court.

Guys, i need a bit of advice please
On the 30th, i purchased a tv for £1050 with savastore. IT arrived on the 1st of september, and all was good. I didnt have chance to open it and look at it untill 2 nights ago, and this is where the problems start.
No power cable. No power cable in the box, so i had to use a kettle leed to test it.
Faint lines. 2 Faint lines, so faint that you can hardly notice unless really bright coulors on the screen. Annoying, and with spending this kind of money id expected perfect.
Quality. Was just not impressed, quality was awfull, and im using top quality leads.
Next day, i contacted savastore who said that they will arrange for osmeone to pick it up, and then they will test it and if found faulty i will get a refund. However if found not to be faulty, i will be liable for £10 plus the carriage charge!. Then, i recieved an email claiming i would not be allowed to do this, and that iw ould have to take it up with samsung. I rang them back, to be told they made a "mistake" (more like trying it on) and that they would have a courrier pick it up on the 18th.
So it now stands that im waiting for osmoene to pick it up. However i do have a few worries about this. Mainly, im worried with the faint lines being so hardly noticable, that they will test it and just say "looks fine to us" and try to make me keep the set and pay the extra. Also that they will just say "oh, here is a power cable then" with regards to the missing cable.
PAckaging is all mint, only the remote has been taken out of the plastic. Can anyone advise me on the situation, as id like to buy another tv now, but dont want to unless im sure i will get my money back.
Also, i purchased it on a citibank card.
Thanks.Waddle you do eh?0 -
Also forgot to add that i have noticed a dead pixel on it.
they have picked it up today, and i incluided a note with all of the faults i have found.
Anyone advise , as i want to order my replacemtn from empire direct tonight, but dont want to end up buying that and then having savastore refuse to refund me.Waddle you do eh?0 -

You should write, recorded delivery, to the dealer rejecting the item as 'not being of merchantable quality' and ask for a full refund. If your citibank card is a credit card and not a debit card, copy them in ther correspondance and tell them they are equally liable for the problem.
Your subsequent message about missing pixals is not so easy to advise. Most screens are allowed to have a certain number of missing pixals and you need to check the dealer's site to find out their limit.
