    Thank you for the reply. Their sofas were bought with gift vouchers from their wedding and although the combined cost was £400 (it was on a buy the sofa bed get the sofe free) if bought seperately would have been £650.Still it was a lot of money to them and should last more than 14 months with only the 2 of them using it. Will definately follow it up thanks again Julie

    Companies always try to abdicate their responsibility by telling customers the goods are outside the 12 month guarantee. If this went to court they would ask if it is reasonable for the goods to fail in such a short time. The answer is 'no' and you would be awarded judgement with costs.

  • hi all, first time posting, on ANYTHING, so hope i'm doing it in the right place..
    i ordered a tft monitor from PIXMANIA, (£165 plus £10 p+p), advertised as having dvi input. when i got it, it didn't, they'd sent me a lesser model, and subsequently changed the website to advertise the lesser model, not the one i ordered. Sent it back immediately claiming on their 'no-quibble' 7-day money back guarantee. (cost me £12.00 to send it.) was told a month later that they'd refunded my money, £165, NOT including their delivery charge. Is this right? can they charge me for sending an item that was misadvertised and that i subsequently rejected? i've not kept all of the e-mails i've sent them 'cos they were on an internal form on the website, not through my e-mail program, but i have most of their replies. I've been told i have to send my postage receipt to france to try to claim that back, which i'm happy to do, but is it right that I should pay for them to post the WRONG item to me?
    hope someone has an idea, i've since heard a LOT of bad things about pixmania, wish i'd heard them before!

  • hi all, newbie alert!!! hope i'm in the right place.

    bought a tft monitor from PIXMANIA (spit)for £165 plus £10 p+p, advertised on the website as having a dvi input, but when it arrived, they'd sent the lesser model instead without DVI. I sent it back immediately, (at a cost of £12.00) and a month later they tell me they've refunded my money, (not gone into the bank yet though) but the total they've refunded is £165, for the monitor NOT the delivery. Is this right? can they charge me for delivering a mis-advertised product? or should i be able to get this back from them? they say i have to send my postal receipt to france to claim back the cost of sending the monitor back to them, but their reply when i asked them about a FULL (including delivery) refund was this...

    "Thank you for your email. When you send the product back for refund using your satisfied or refund -right, we only refund the price of the product, not the delivery costs."

    Is this right?
    i've heard a LOT of bad things about pixmania, only wish i'd heard them a bit earlier....

    Where did you buy the monitor from? If you bought it in the UK then your postage should be refunded from the same place. Don't be put off by their suggestion to deal with France.

    Write to them telling them that they have not supplied goods as advertised and you want a full refund including all postage costs. (£10 +£12)

    If they refuse you can take them to the Small Claims Court but you must decide if this is worth it. On top of your £22 you could also claim for packaging, phone calls etc so you could get a claim in the region of about £40.

    If you decide to go to court mention it in the letter asking for your money back.

    One other possibility, if you paid by credit card contact your card company for help.

  • thanks art, but is there a trading standards quote i could throw at them or something, as you can see from me second post they've told me they don't refund postage already.. i scoured the trading standards website but couldn't find much about postage etc...
    i know it's only a small amount, but
    a} they shouldn't get away with this sort of service, and if they do, multiplied by thousands of customers, this is a gigantic ripoff, which could be prevented if they sent the right thing in the first place! and,
    b} i'm skint!

    As the transaction was carried out in the UK then you should tell the company you are not prepared to put up with their delaying tactics and if you don't get your money in 14 days you will go to the Small Claims Court.

    When you use the court you have to pay costs up front but this is only a small amount and is eventually paid by company if you win.

  • Guys I need help!

    I brought a Motorola L6 on the 29th August from Tmobile, today I tried to ring my husband and its as if I don't have a microphone no-one can hear me but I can har them, I've rung landline/mobiles and had them ring me but still the same problem. :confused:

    T mobile phone CS said they would send it for repairs, but I'm not happy with this as the phones only 11 days old and its already faulty. I would really like an exchange is there any guidlines that say that 11 days is not acceptable for faults?:mad:

    I'm really annoyed my last phone a motorola V550 I had for 4 years! I'm not a mobile tart and I treat them really well!

    Any help guys would be most appreciated!

    A couple of weeks ago I purchased an Asrock motherboard from Terabyte Computers using my credit card. When it arrived, I discovered they had substituted my order for a different board (an Asus motherboard) as mine was out of stock. I wasn't too concerned at this stage as the make wasn't important, the features were and the new board has all the features I wanted. They also only charged me for my original order.

    I plugged the board in and it didn't work. I tried it with several CPU's, RAM and PSU's, all known good parts and it still didn't work. I might add that I am an A+ qualified PC Support Engineer with 10 years experience. I informed the company within 7 days of receipt that the board didn't work and they issued a RMA number to return the board. I posted it back at my expense.

    As I had not hear from them in about 2 weeks I contacted Terabyte computers who confirmed that they had received the board and tested it and found no fault with it. As they had found no fault the board would be returned to me after I had paid a £25 testing fee which is clearly stated in their terms and conditions on their website.

    Obviously I do not want to pay this fee and I want a working motherboard or a full refund. If I attempt to return the item under the sale of goods act, they argue that the item is not faulty (so is therefore fit for purpose) and if I try and return it under the distance selling act (through them substituting my order), they say the item must be unopened which it obviuosly isn't. also I didn't notify them with 7 days that I wished to return it under the distance selling act.

    What else can I do or am I screwed and will just have to pay the £25 or let them keep the motherboard?
