We ordered a mini fridge a while ago and when it was delivered we found it to be badly dented at the bottom. We called the online retailer who said they'd replace it and to expect a courier on a specific day to deliver a new one and pickup the old one. The courier came and delivered the new one but refused the old one because he had not been told to collect it. So my question is how long do we give the retailer to make arrangements to collect (we can't afford another day off work just for some thing to be collected)? Is there any law like the unsolicited gifts that after a certain time from the retailer being asked to collect the item becomes your property?"She is quite the oddball. Write to the retailer explaining your situation. Ask him to make arrangements to collect the item from you and say that if it is not collected in 14 days you will dispose of it yourself.
Keep a copy of the letter and send it recorded delivery.

Tell Argos, in writing, that the oven is not of merchantable quality and not fit for purpose. Tell them you want a replacement or your money back. If they refuse take them to the Small Claims Court.

I had a reply back from Argos apologising for the problems and advised me to go into one of their stores and to speak with customer services.
I went to the Argos Store that i purchased the microwave from on Saturday, explained what had happened and gave the lady all my correspondance. She went away and said the manager was taking a look at everything.
Within 20 minutes, i had been a new turntable and everything sorted!!

Hi
I recently received an item from Pixmania.co.uk that was not what I had ordered. I had paid by credit card and returned the item as instructed. I have now received an email advising that the item has been refunded to my 'bank card', however, they did not include a refund for the delivery postage to me. I was happy enough to pay the return postage myself as it was less than £2.00 but the delivery postage was a lot more and as it was their error, I do not feel I should pay this - am I right?
I tried calling their customer services twice but ended up with a recorded message in French then got cut off. I am now awaiting a response to an email sent through their website, but just wanted to check what my rights are as I have since found out that I'm probably lucky to have been instructed the item alone has been refunded as their after sales service seems very poor.
I have copies of all correspondence.

They should have returned the delivery charge as well. I guess it is small enough that it is pointless going to the small claims court. Just pester them on the email and hope they will pay up to get rid of you.

I had a problem once with pixmania when they sent me someone else's printer as well as my own. When I told them they wanted me to post it to them and they'd refund me the postage!! I told them point blank I wasn't going to pay for posting something they sent me by mistake, after putting me on hold for a minute he came back and said they'd send a courier to pick it up. Dear all,
As this is my first post I'm hoping I'm posting this in the right place.
I bought a display tent from a local shop on 11/08/06 as I'm still unsure of web shopping. I was assured it was ok - but needed a clean. It took until Tuesday to put it up in my garden due to the weather and finding someone to help me, and then in between looking after my kids and dodging the weather I got it cleaned up by Sunday. When I was able to take it down on Sunday I found that one of the poles had split. I tried taking it back to the shop and they refused to give me a refund as it was over a week and it was a display model and told me that if I wanted to get a solicitor to write to them, they would respond. I phoned trading standards who told me that under the sale of goods act even a display model has to be free of defects (unless I knew about them before hand) and basically indicated that I would have to prove it was faulty - and it would cost me £30 to go through the small claims court. I know £110 isn't alot of money to some people - but adding an extra £30 that I don't have is really worrying to me. (I specifically told the salesman that I wanted to buy locally in case I had problems - and now I wish I'd bought from the internet anyway.) I have no faith in this tent now if poles don't even last 5 days in a back garden.
Is this worth pursuing (is there anything else I can do that won't cost me more money), or do I just put this down as an expensive mistake and learn not to trust a word of what salesman tell me?0 -

You seem to have a justifiable claim here. Write to the retailer pointing out that under the Sale of Goods Act you are rejecting the item as it is not of merchantable quality and ask them for your money back (or replacement pole if that is what you want). Send your letter by recorded delivery. Are they part of a larger group? If so copy the head office in with your letter.
If this brings no response your only alternative is the Small Claims Court. You will have to pay the court costs up front but if you win your case the costs will be awarded to you as part of your claim so you will not be out of pocket.
