I bought something from a EU company for about £50 (paid by credit card). It is nearly a month but I am yet to receive it. Contacted them and they said I have to wait as it can be just the slow post.
What options do I have? I understand that UK laws require delivery within 30 days - does this apply to EU as well? Can I use the small court to sue EU companies? Thanks.Mark Hughes' blue and white army0 -
Art wrote:Hi Claire,
It really depends on your local court system. Some are quicker than others, and of course with the holiday season upon us that may slow things down a bit. A phone call to your particular court may give you a clue.
Before a hearing can be arranged Currys have to be sent a copy of your complaint and have an opportunity to respond. Once they respond the court will then read papers from both sides and if they agree there is a case to answer they will then give you a date.
I still think Currys will try to settle with you. If they try to do so just make sure you get what you regard as a fair settlement. If not carry on to the court.

Art.
Hello again Art,
Just a courtesy post to update you on our claim. We received a letter from the court this morning confirming that Curry's have acknowedged the claim and have asked for 28 days to prepare there judgement.
So were slowly getting there although I am disapointed they didn't settle with us we are still confident of getting what we asked for from the courts.
I shall keep you updated,

As you paid by credit card they are equally responsible. Contact them and ask them to refund your money.

Hi Claire,
Good to see things are moving, albeit slowly. Curry's may still settle. Once their head office gather the information from the shop they may see it's best to not go to court.

I'm sorry, didn't notice the value. You can't use the Small Claims Court on something like this. Your only option is to keep on at them.
Have you asked them for proof of shipping? This might be useful in case they are stringing you along.
Most parcels from mainland Europe should be delivered in under two weeks.

Hi,
I purchased a duraband digibox from asda in april and it has started to not work properly. Unfortunatley I do not have the receipt any more but I do still have the box. Do you know if I have any rights still. I noticed the other day they are no longer stocking them so I dont think I will be able to get an exchange.0 -

Asda has a good reputation for customer care so I don't think you will have a problem with them. Take the unit back to the store and explain your position to them.
If they don't do the model anymore they may offer you another model.

Thanks Art I will try them. I have returned items in the past that had no receipt but that was only because they had been recalled.0
