nelliebag wrote:BOUGHT MY SON A PAIR OF SHOES AT jjb SPORTS AT THE END OF AUGUST. hE HAS NOW WORN THEM FOR 4 WEEKS AND THE SOLES HAVE FALLEN OFF THE SHOES TWICE AND NOW THE SIDE SEEM HAS BURST ON ONE OF THE SHOES. JJB HAS REFUSED ME A REFUND AS THEY SAID 'HE HAD MESSED ABOUT IN THEM - WHAT CAN i SAY ?
Firstly, check that the shoes were specified for the purpose he is using them for. If they are casual shoes and he is using them for tennis/baseball etc he is misusing them.
If you are happy that he are using the shoes for the correct purpose tell JJB that you want a full refund as they are not of merchantable quality. If they refuse, and the shoes are worth it, take them to the small claims court.
Write to their head office with your problem. This often brings results.

I booked a band through an agency to play at our wedding. I signed a contract and gave the band over 4 months notice to learn our first dance song for us, and play it at the wedding, although this wasn't stated in the contract.
I do however have an email from the agency, confirming that the band would learn our song for us.
On the wedding day, 2 minutes before the 1st dance was to begin, the band informed us that they wouldn't be able to play the song very well, and would have to play it on CD instead. So we had no choice but to let them play it on CD.
I have since contacted them as I feel that I am owed some compensation for them failing to learn and play our song for us. They are just fobbing us off with excuses why they couldn't play it. If they had given us some notice we could have chosen another song from their set list that they could have played. I feel they have acted unprofessionaly and unfairly, and aren't willing to compensate us for messing up on our wedding day.
Do I have any rights? I feel cheated. As I've said, it wasn't in our contract although I have an email from the agency saying they *would* play the song for us.
thanks to anyone who has any advice. We're all pawns in the game of life!!0 -

I think you are on thin ice with this one - sorry! Even if you got some compensation it wouldn't be much and I don't think it's worth you taking legal action.

I recently went to a "Lidl" car park sale and bought various items.
One of them was a pillow that you put some water in and it leaked, i bought 2 of them and took them back to Lidl and the manager told me as it was a car park sale you arnt entitled to a refund, there was no signs in the car park to say this in hact there were no signs at all and the manager said they didnt need any and no receipts were given , i said if i had bought a £20 electrical item and got i home and it didnt work it would be tough luck> He said yes.
Now he did give me the refund in the end but wondered what is the position if i buy items in the future from these sales, it seems a bit fishy to me0 -

If this was a sale organised by Lidl they are responsible under the sale of goods act.

Hello I would really appreciate some advice.
I signed up for Virgin Wines club where they send you a case of their selected wines each month. They E Mail each month to check that you want it and when they E Mailed in September I immediately replied saying "No thanks". They E Mailed back to say OK the membership was cancelled and should I ever wish to re join just contact them.
Yesterday there was a big box of wine in the porch from Virgin. I have E mailed them to say don't charge my card for this and forwarded all ou recent correspondence to their 24 hr response help desk. They have not replied and my OH says that we can keep the wine because it is an unsolicited delivery. Is he right?0 -

Write to Virgin and tell them they have delivered unwanted goods and you expect them to arrange to collect them at their expense. Inform them that if they have not done this in one month you will assume you are able to enjoy the wine at their expense. Don't use the wine until you have informed them of this. After that - Enjoy!
